Air travellers to be Compensated for Delayed, Cancelled Flight


New Delhi, Jun 21, (PTI): Air travellers would now be compensated for cancellation or delays in flights which have not been caused by situations like fog or any reason beyond the control of the airlines, if a new draft rule is implemented. 

New rules detailing the conditions of compensation have been drafted by the aviation regulator Directorate General of Civil Aviation, which has invited comments from the public before finalising them.

The decision came in the wake of rapid expansion of air services on domestic and international routes and the necessity for the government to ensure appropriate protection for air travellers in case of flight disruptions, denied boarding, cancellations and delays without due notice to the passengers, an official spokesperson said.

As the distinction between scheduled and non-scheduled services was coming down, such protectionary measures would also be provided to passengers travelling on non-scheduled flights, like charters, also.

The new rules or the Civil Aviation Requirement (CAR) would bring the Indian aviation law in tandem with the Montreal Convention in regard to the liabilities of the airlines.

The operating airline would, however, be under no obligation if the cancellations and delays are caused by events beyond its control, like natural calamities or political instability.

Under the draft CAR, the financial compensation would be given only if the amount of tickets cost is higher than the compensation amount.

It would be Rs. 2,000 or the value of the ticket whichever is less for flights having a block time of up to and including one hour. Till two hours, the compensation would be Rs 3,000 or the value of the ticket whichever is less.

Similarly, if the delay is more than two hours, the amount would be Rs 4,000 or the value of the ticket whichever is less.

The draft rule provides that alternatively, the passenger would be offered the choice of a refund at the price it was purchased, a flight to the first point of departure and alternative transportation to the final destination wherever applicable.

Besides, the passengers shall be offered free of charge meals and refreshments and hotel accommodation, including transfers, when necessary.

    It would be a welcome move if the civil aviation ministry will implement this policy.Many airlines are taking the passengers for granted simply for their carelessness.BUT...MR.PRAFUL PATEL IS REALLY SERIOUS IN THIS ISSUE OR JUST DIVERTING THE ATTENTION OF THE PEOPLE FROM HIS PARTY CHIEF CONNECTED WITH IPL ROW???

    Ofcourse it is a good idea if it is implemented. First of all Airindia Express may be the heavy looser on this. Let us pray for implementing this rule.

    A very good move, but ultimately on an avarage proportion, airline will charge us as hidden costs !!This will increase the ticket fares.

    It is a V.good move, hope the rule will be implimented soon. I suggest Civil Aviation officials to visit Mangalore(Bajpe) Airport during the late night/early morning when international passengers waiting due to delayed flight. At present if the night flight is delayed, international passengers will not find cafetaria or vending machines operating in the waiting area and there is no TV available in first floor waiting hall. Hope airport official will wake up and act.

    I think it’s a smart rule, in order for the air line to fly always not on time! As you see the 2 hours delay cause 4000 rupees or ticket value whichever is less!! Suppose in this case, if I am flying from Mangalore to Mumbai, say the cost is 6000 to 7500 rupees (usually that’s what I pay for jet), in this scenario if there is a delay of 2hours! The airline can then inform me hey " here you collect your 4000 (which is less in this case) and get a train from kankanadi"! ??
    Or is that the airline still forced to fly even in case of a technical problem as they might need to make a big pay when the time fly!!??

    If by the the flight gets delayed and then the compansation is too be given, i think we need to spend double the amount of compansation to get that compansation money. all fake.

    Air lines delays are getting very common, and at times, unexpected weather conditions can create
    delays.

    But, a lot of other delays and  cancellations are quite common due to the negligence and " we don't
    care" attitude of the employees.

    How many airlines strikes are taking place in India for silly reasons?

    Air India will break all the records in creating deliberate delays  due the employee's attitude.

    So, the airlines, which ever it might be, must pay their share of penalty for creating delays and
    cancellations. Airline passengers are paying for their travel, and if they are not getting proper service, they deserve cash rewards in accordence with the inconvenience they had to suffer. The new law is highly commendable, and must be implemented in full force.

    Already airliners are running in loss. And this implimented then they would have forced to stop the service permanently.Because all the airlines are Delay everyday for small reasons.

    This is just a regulation. What are the other reasons than fog or any reason beyond the control of the airlines. Let Praful Patel or Aviation Department specify any reason beyond the control of the airlines. This is just to fool people. I think Civial Aviation want to divert their problems by giving unwanted reglations. Let people do not get exited by these regulations as there is no specification on the compensations to be received.
