High court grants interim approval to Udupi woman for holding prayer service at residence


Bengaluru, Dec 25 (IANS): The high court (HC) has granted interim approval to a woman for holding prayers at her residence in Udupi district of Karnataka on Friday.

The lady from Udupi, Esthela Louies has questioned the police notice issued to her in the court.

She claimed that the notice by the Karnataka police on October 26 has violated her fundamental rights. She prayed before the court that she has been conducting prayers since 11 years at her residence. The police stated in their notice that she was holding gatherings without police consent and license and it was a violation of law. The police had asked her to submit documents in this regard.

Considering her plea, a bench headed by Justice Krishna S Dixith, permitted Esthela Louies to hold service meetings. It also instructed her not to disturb the neighbours. She was also asked to honour the condition that police personnel are free to make audio and video recordings of service meetings.

The court has also stated that there should not be any large congregations at the house.

The order will be in place until the next hearing. Esthela Louies's petition claimed that she has been holding prayers and is involved in community services since 11 years.

The prayers are being conducted at her residence in Devalkanda in Kundapur taluk of Udupi district on Fridays and Sundays. Meanwhile, a police notice was issued by the Kundapura Rural police station house officer questioning her on hosting service meetings. She challenged the police notice of the court claiming that it violated her basic fundamental right.

The petitioner has also given undertaking to the court that she would see to it that there would be no large congregation and Covid guidelines are followed and neighbours are not troubled. She has also mentioned that she would not give room for any allegations of religious conversion activities.

The counsel for the government stated that the petitioner's residence is located in a communally sensitive area and the congregation at her residence is likely to pose threat to peace and harmony and law and order situation as well.

    Every individual has right to select a religion of his choice and profess the same within the four walls of his house. But this lady conducting prayer meetings weekly twice inviting many outsiders is a community activity and can not be justified on the basis of individual’s rights to pray. When you are conducting such activities, it affects the peace and privacy of immediate neighbours (even if they belong to the same denomination / faith). These prayers can not be equated with Gana Homa which is only an occasional activity. The purpose of the prayer in this case cannot be seen as an individual need and also the opposition to the prayer has more to do with the political ideology than real reasons as the lady is supposedly conducting prayer services for past 11 years. Also there are enough provisions in Police Act regarding the number of people that can be assembled at a private function beyond which prior permission need to be sought. Religion is a matter of personal choice and State should not interfere as long as it remains an individual matter. IF someone wants to convert, let them file an application with the Registrar (similarly on the lines of Special Marriage Act) and same may be published for raising objections, if any, (only from close relatives as defined by the Companies Act) and if no objections are received within the stipulated dates, let them allow conversion. Police need not be employed to verify the reason for conversion as envisaged in the Anti Conversion bill as they have better things to do.

MY LIBERTY OF MY CHOICE IS MY BUSINESS AND MY CONSTITUTIONAL RIGHT. AND THE STATE GOVERNMENT HAS NO RIGHT TO INTERFERE IN MY PRIVATE LIFE. FILING AN APPLICATION FOR APPROVAL TO CONVERT TO ANOTHER FAITH IS A BLATANT ENCROACHMENT IN MY PERSONAL LIFE.     satya meva jayate. praying & worshipping inside my home is a personal liberty given in da constitution. in our vicinities every time, every nooks & corners brahma kalasa (ಭ್ರಹ್ಮ ಕಲಶ) is going on & loud noise is made dancing on da roads, loudspeakers r used, everywhere otthe kola (ಒತ್ತೆಕೋಲ), bhoota kola ಭೂತ ಕೋಲ), whole night yakshagana (ಯಕ್ಶಗಾನ) chande maddale (ಚಂಡೆ ಮದ್ದಳೆ) such loud voices r made & dee's fundoos, idiots r mute & don't hear at all.

    Gathering and prayer acceptable BUT no to conversion by force / inducement. Actually roman catholic community not involve in conversion racket but surely newly formed Christian groups actively involved in conversion. Let our state enact anti conversion bill at earliest.

    They are called first generation christians..., organized churches are not seen engaging in this job of conversion.., but irony is that..., the organized church leaders are on the streets to fight against this new law..., New law should be welcomed... as it stop FEKU converts (lust for money...., as alleged by the ruling govt).., in a way it may be good., those who are in need of money let them covnert get the money..., then gharwapsi..., fayda ka bath hai na....!!!!!

    All congregations are well organized. No organisation is promoting conversion by force or by inducement of monetary favours. They are involved in preaching and propagating the faith, not in conversion against anybody’s will. However, existence of underground cells involved in conversion with dangerous motives has been unearthed in our neighbouring state.

    Now a days... bring any laws … in order to attract the provisions of law to punish.., any body can voluntarily confess/allege with a motive that he/she has been asked to convert forcibly...!!!, then it become incumbent upon the accused to prove that he/she is innocent..., till such time BD/Cheddi will be on the streets celebrating on the streets....!!!!! with this touch of FEKUISM, I leave it the wisdom of fellow Hindustani's to make their own conclusions...,!!!!! After all I am totally against conversions..., if at all such things happen in search of peace by Hindu's... it is time for Hindu pontiff, seers, swamiji's(not FEKU one's) to take onus to admit that they fail to counsel/comfort the downtrodden & depressed Hindu's in modern society filled with toxic information/news/preaching's/ reports..,,
