'Hijab is farz, courts not equipped to determine its essentiality', petitioners to SC


New Delhi, Sep 14 (IANS): The petitioners on Wednesday told the Supreme Court that according to the religious text, wearing of hijab was 'farz' (duty) and the courts were not equipped to determine its essentiality.

Senior advocate Rajeev Dhavan, representing some petitioners, submitted before a bench comprising Justices Hemant Gupta and Sudhanshu Dhulia that once it was shown that wearing a hijab is a bona fide practice then it was permitted, while citing the apex court's decision in Bijoe Emmanuel case. Dhavan said that the conclusion of the Karnataka High Court was puzzling, as it said hijab was not mandatory due to the absence of prescription of penalties.

The bench queried Dhavan that his argument was that the courts were not equipped to decide the matter, and if a dispute arises then which forum will decide it? Dhavan said what was the dispute? Whether hijab was an essential practice? He added that hijab was worn all over the country, and as long as it was bona fide and prevalent, the practice must be allowed and there was no need to refer to the religious text.

Dhavan argued that according to the tenets of the faith, if something has been followed, it was allowed, and if it was bona fide, there was no need to go back to the text. Also, if a belief of a community was proved then a judge was bound to accept that belief, instead of sitting on a judgment on that belief, he added.

Citing the Kerala High Court decision, he added that the analysis of the Quranic injunctions and the Hadiths would show that it was a 'farz' to cover the head. The bench queried, what was the basis of saying it was a 'farz'?

Justice Gupta told Dhavan, "You want us not to do what the Kerala High Court has done?" He replied that "if one were to interpret the text then the answer to it is farz, and if it is a ritual that is prevalent, and is bona fide, your lordships will allow."

Dhavan further added that the rationale in the Kerala case given by the Board was that it was a measure to prevent malpractices in the All India Pre Medical Test (AIPMT) in 2016, but in Karnataka case, there was no rationale given. He added that hijab was permitted across the board in public places, so what was the basis to say hijab can't be allowed in a classroom and was opposed to public order? Concluding his argument, Dhavan said there was no foundation in the government order against hijab, it violates Article 14 and 15, and this was not permissible in the Constitution.

The hearing in the matter will continue later. 

The apex court was hearing submissions on the fifth day against the Karnataka High Court's judgement of March 15 upholding ban on Hijab in pre-university colleges.

    Good analysis. No wonder they only take but don’t give to non believers. It’s sad but god is the master for many Christians donors and many Christians nations accommodating large groups of refugees from Islamic nations. Hope all these people stop fighting for religious matters and start working towards eradicate poverty . Yes we Christians are also harrassed by fanatics groups but we don’t fight rather work for peace

    Senior advocate Rajeev Dhavan apparently does not know much of the very basics of Islam. These are the only 5 (five) things 'FARZ" ( IT IS A MUST TO BE PRACTISED). The rest is Sunna & Hadiths, which means that it is the ways and sayings of the prophet and a preferred way of the practice. These are 5 Pillars of Islam, which are FARZ and they are 1. Profession of Faith (shahada). The belief that "I bear witness there is no God but God, and Muhammad is his Prophet" it is central to Islam to say this one line in Arabic only to join this belief system. 2. Prayer (salat). Muslims pray facing Mecca five times a day: at dawn, noon, mid-afternoon, sunset, and after dark. 3. Giving of Alms (zakat) which is 2.5% of your wealth in Charity. It is to be noted that when Muslims donate that money it can only be used towards the development and upkeep of the Muslim Community, and not a single paise can be given towards any non Muslim or non Muslim causes. 4. Fasting (sawm) from sunrise to sunset in the month of Ramadan. However, it did not take into account people living at the poles, who DO NOT have sunrise or sunset for 5-6 months of the year. 5. Pilgrimage (hajj). Going to Mecca & Medina.

    @don mangalore, going to pilgrimage is worthless. u can attain God's mercy from your good deeds wherever you are. pilgrimages to jerusalem, bethleham, mecca, madina, amarnath, mount kailash, kaasi, varanasi will never take you to heaven without your good deeds and the good deeds can be accomplished by any people of any nations like u.s.a., australia, france, germany, u.k., india, srilanka, china. russia.

    Why the Hijab issue was not discussed in the state assembly by the state BJP govt with experts, religious leaders, stake holders and opposition parties?. Why was this issue allowed by the govt to be used and manhandled in the public places by its activists and criminals on Muslims girls?. Govt listens only to its street goondas cries and actions and not by any hardworking, law biding and tax paying citizens. It was another pre-planned mis adventure by the govt to achieve its selfish motive through back door without following any democratic procedure but done unanimously.

    It’s not a rocket science for anyone to decide right and wrong. Ban everyone wearing religious attire in publicly funded schools and colleges. Why open up unnecessary discussion to get expertisey in religious matters. Just ban and stop the discussion s but do it for everyone without bias. All these religious logos on food and cloths are the curse on law abiding citizens and never ending stories of tradition started donkied years ago . Now tax payers end up paying for all these things not warranted. This is happening everywhere and need to be stapled. Keep public space for public and religious space for religions don’t mix and impose on others

    Dont go this far guys! You keep your ' Farz' at home or anywhere else. In school you respect the uniform. Or else join other institutions where this attire is permitted. Its so simple. Why create a nuisance for other students??? Did you guys realize that portions were not completed due to the protests? Students have got low marks because they had to skip questions. Please do not impose this on others. I am a teacher and I am with the students who have suffered due to a handful of these elements, who later took TCs.

    Medical students are wearing hijabs in classes !!!!. How will these students practice medicine covering their faces ??????. It is strange that these girls don't want to integrate themselves in society but want to stand out because of religious beliefs.

    I have heard of many instances wherein the Hijab and Burqa are imposed among Muslimaas to wear. Many Muslimaas are not liking to wear but these fundamental males are overpowering them in the pretext of Quran and Hadith's verses against females.

    Dear alponse, Like you said there may be many who are imposed.. So that concludes many are not imposed and willingly adopting hijab/purdah/headcover. Have you seen sari clad village women from north india with long ghunghat covering there head? Have you seen nuns? Lets respect the choice of diverse people.

    @ Rahul, dxb, Let me clear it to you about the attire of Nuns. Whoever is becoming a nun, it is not from their will, it is the calling from God to them and whenever they join they choose a congregation. These nuns congregations have different kinds of attires and they choose those attire. Where as the Purdah, Burqa and Hijab, Head Scarf are imposed by men on Muslimaas, if not wearing they are beaten in the pretext of the quran. accept the truth mentioned by me.

    farz aap log nibhaale. lekin school aur colleges mem nahim. when a judge & lawyers r having uniforms, da students also have their prescribed uniforms. so must wear uniforms. sikhs having kripan is mentioned in da constitution whereas hijab & burqa r not mentioned in da constitution.
