Guidance value of immovable property to be hiked by 30% in Karnataka


Bengaluru, Sep 19 (IANS): Karnataka government is all set to hike the guidance value of immovable property by 30 per cent from October 1.

The government expect a revenue of about Rs 2,000 crore annually in return.

“There is a rule as per which the guidance value of property can be revised once in a year. In this background, we are hiking the guidance value from October 1,” Minister for Revenue Krishna Bhyregowda said.

He said that there is going to be a 30 per cent hike. “The hike will not be applicable everywhere. Wherever the guidance value is below the market rate, the hike will be applied,” he said.

He said that the guidance value is lower in regions where national highways, airports and IT and BT industries have come up.

“In these regions, the guidance value is going to be increased by 30 per cent. There is a time limit for filing of objections. The government notification will be issued after looking into the objections,” he said.

He said that there might be little inconveniences due to the hike in the guidance value of the properties and it is going to be settled in one or two months.

“The black money is being used during the sale of property. There are going to be pros and cons when the new rule is made. The law says revision of guidance value should be made every year. For five years, the guidance value has not been revised and hence we are doing it,” he said.

He said that the state government has decided to use an app to identify the government land and that app will be released in a few days.

“The app will be given to the village accountant and on spot inspection will take place. The app will detect whether it is government land. If there is any encroachment, then the district commissioner will take action,” he said.

He said that the beat system will be made and for every three months an assessment will take place.

“The lands were grabbed in Bengaluru and judgments were taken in their favor by giving false information. The officers were given wrong information,” he said.

Sources said that the guidance value is going to be up in the north Bengaluru area which is seeing a boom. The rates are also going to be hiked in the surrounding areas of Devanahalli where Bengaluru International Airport is located and Chikkaballapur district located close to Bengaluru urban district.

The rates in Mysuru, Mandya and Ramanagara districts where Bengaluru-Mysuru Expressway is built, Shivamogga, where the new airport started operating will also see a rise in the guidance value.

    Already property rates are sky high that a middleclass family can't be able afford to buy a 30x40 site (3 cents ) or 2BHK flat. Living has become a hell due to the day to day skyrocketing household expenses, house rent, school expenses, medical expenses and what not? Just forget buying properties, it's not worth. Even if you buy a good property of your like, there will be one or the other problems created by property litigations which may spoil your overall health & wealth for decades. Just take a health insurance, term insurance, try to buy 1bhk apartment in the outskirts, keep in good health, eat well, enjoy life, travel around & enjoy with family till we live on this earth. This is the need of the hour.

    Very true Kiran; buying property for investment and finishing off your savings or on a loan is utter foolishness! As you said, it's best to stay in a small flat or on rental! I think the property rates have been jacked up too much; bubble is bound to burst; many NRIs are desperately trying to sell their huge mansions at distress rates because there's nobody to stay in the house and giving a big ticket sized property on rent by giving POA is fraught with dangers of the entire property getting usurped; it's a trap!!

    This was expected while they announced gifts... Actually guidance values are far les than the ruling values in almost all land parcels... Is it not a good idea to bring them to almost par with real values?... What is the rationale in showing much less on paper when govt looses crores of fair transaction levies?... One thing is but very clear... Gifts of congress have been welcomed silently by even hardened Bhakts...

    Very high disparity in MV and GV gives rise to artificial jacking of rates which are not sustainable over a period of time; one example is Mangalore where the supply is very very high than demand, but still rates are not going down; investing at such high rates is senseless unless it's for end use!

    The guidance value should be same as market value, this will reduce black money in property deals. At present the GV is less than 10% of MV at many places in Mangalore. The Incometax department has already collected MV details in all localities in Mangalore, so there is no escape, those who quote less will get a notice after 2 or 3 years and then face the music.

    Monty; the MVs are too much artificially inflated in Mangalore; just take a round in the prime parts of the Smart City and you will know the ground level situation by seeing the number of shops which have pulled down their shutters and waiting for customers; it doesn't make any sense to run a business by paying such exorbitant rentals; moreover with the unprecedented drought which will lead to hyper inflation and acute shortage of potable water it's just a matter of time that the realty bubble will burst!!

    How can IT ascertain the MV and what if the registered value is more than real GV after indexation? I do not believe any notices would be slapped against such case and if there is some capital gain shown in the transaction.

    There are IB people who inform the CBDT( there are around 10 in Mangalore)about the MV of the transactions done in property, they know how much was paid in white and how much in black. This is recorded audio direct or telephonically. Even if you register the sale deed as per GV , the IT Dept has the actual details with them about the total amount paid. The capital gains tax is determined by the actual amount paid, not GV. Now the procedure is of anonymous assessment, you do not know who is the AO and the AO does not know you, so no underhand settlement is possible. I know of people who have got notices and were confronted with documentary proof by the IT Dept. It comes under "360 degree" profiling.

    In Karnataka you can get the GV online, the website is kaverionline.karnataka.gov.in. You have to navigate to the district, village ,hobli and the locality and road. At present the GV is only 10% of the MV in nearly all places in Mangalore ( and I believe in other places also ).

    If Black money is being used for receiving payments on sale of properties, why isnt there a law to cover this black hole to ensure payment received for sale of any property is governed by Cheque payments only. "Lands were grabbed in Bengaluru, because Officers were GIVEN wrong information". The ex Chief Minister of Karnataka, Yedurappa claimed a long time ago, when asked, how all his relatives own large prime lands, his answer to the media was, all before me in this post have done so, why should I not follow! My dear Krishna, wake up! Officers were also given the moolah too, to look the other way. These are the Officers who are on the Developers & Builders Pay List who give all approvals, BUT not for free! Corruption starts with absurd laws and illogical tax hikes that give rise to corruption that begins in all government offices and making housing unaffordable. Every year the House Tax is raised, and you are stating for the last five years the guidance value is not raised. Then how is the House Tax raised?

    Very good move ...it does help land owners and govt but please create and app which can alsohelp identify private lands being encroached by others ....sir every inch of land should have an owner govt or privately owned ...bhoomi now is getting better for sure but documents when changed or new added khata holders should be informed ...
