Cabinet Decides to take Action against 417 Officials on illegal Mining

Bangalore, Oct 29: After the prolonged examination and consideration, the State Cabinet has finally decided to accept the report submitted to the Government by a high-level official committee headed by Additional Chief Secretary K Jairaj, which studied the final report of former Lokayukta N Santosh Hegde on illegal mining and export of iron ore and has approved action against 417 officials indicted in the report.

The State Cabinet, which met on Friday evening under the Chairmanship of Karnataka Chief Minister D V Sadananda Gowda, has accepted various recommendations made by the high level committee.



Law and Parliamentary Affairs Minister S Suresh Kumar, who briefed reporters after the State Cabinet meeting, said the Jairaj panel had recommended constitution of a Special Investigation Team (SIT) comprising officials of the Mines and Geology, Forest, Revenue and other departments concerned to further investigate officials/persons involved in illegal mining.

The Lokayukta report recommended action against 617 officials of various departments and the government has identified 447 officials. Action has been initiated against 182 officials. But 170 officials cannot be identified or traced on account of incorrect designation and addresses, the minister said.

However, the Lokayutka report had recommended recovery of losses five times from officials’ involved illegal mining.

But there was no necessary existing legislation to recover losses and file criminal cases against officials. The Government would file civil cases against officials till the amendment to the law, Kumar said.

The Jairaj panel has recommended a state level co-ordination and high power committee to monitor reforms and measures taken up by various departments in connection with mining.
It also recommended setting up of a single window agency for granting permission for mining, transport and export of ore, Kumar said.

The report indicted three IAS officers - Gangaram Baderia, M V Shivalinga Murthy and K S Prabhakar, all former directors of the Mines and Geology Department, and four Indian Forest Service (IFS) officials - Muthaiah, former deputy conservator of forests, Bellary; Srinivasulu, Deputy  Conservator of Forest (DCF), Chitradurga; P Rajashekar, former DCF, Bellary; M K Shukla, former DCF, Bellary.

The panel suggested to the Government to obtain statements from the officials concerned before taking action.

    These are small fishes and their property should be attached pending inquiry.The hurry in accepting official's misdeeds in illegal mining not shown when it comes to politician's !!?Why politicians are kept in waiting?they big fishes and need to speed up actions against them and then only we can say govt's will power in curbing corruptions.

    OH,WHAT A NICE AND SWEET WAY OF EYEWASH.....DUE TO LACK OF NECESSARY EXISTING LEGISLATION, NO CRIMINAL PROCEEDINGS, NO RECOVERY OF LOSSES,NO ACTION AGAINST 170 OFFICIALS BECAUSE THEY CANNOT BE TRACED DUE TO INCORRECT DESIGNATION OR ADDRESS,(but to draw the government salary they have the correct designation and address),CONSTITUTION OF ONE MORE SPECIAL INVESTIGATION TEAM AS PER THE RECOMENDATION OR JAIRAJ PANNEL, AND FINALLY ONLY AND ONLY CIVIL PROCEEDINGS TO SAVE AND SAFEGUARD THESE OFFICIALS.     This is absolutely a very good mood. but one quetion is whether this type of rules applies only to officials or even the ministers, chief ministers those involved in it? Because law should be equal. It should not make partiality between ministers and the officials.

    This is just a eyewash for the public to consume. Note that there is no law to collect the loss amount foregt about 5 times. They cannot file criminal cases against them but civil and we know civil cases will go on till the man is no more. We the people should know the motive behind this is just to fool the comman man and Nagesh Mam

    There was no necessary existing legislation to recover losses and file criminal cases against officials.Waw,what a pity...?After so many years of indepence we still does not have such law.Any Government only interested to increase it's revenue becasuse to eat from it or to be eaten by it's officials.General public ask for such law.Anna asking for such law which congress does not willing.People should act now...

    This is a good move from the government. However the action should be beneficial to the treasury. The Lokayukta panel has recommended recovery of the amount 5 times the amount that was lost. If this is done, the common man will be happy. This is a testing time for the government. If it has the will, it can do it.
