Udupi: Cumbersome process puts land sellers, buyers in confusion

Udupi, Aug 1: Stricter laws with regard to purchase, sale and conversion of land, irrational attitude of the officials has been taking its toll on real estate business in the Udupi district for the last couple of years. This has resulted in reduced revenue even for the government. Yet the officials’ nonchalant attitude has not changed and this has resulted in vexing the residents as they are made to run from pillar to post just to sell or purchase a piece of land, says former president of zilla panchayat (ZP) Bhujanga Shetty.

He added that the coastal districts had earlier been given certain exemptions regarding purchase, sale or conversion of land. Actually coastal districts are not known for acres and hectares of empty lands. Most of the people own just a few cents of lands and hence the land laws which are applied in the other districts of Karnataka cannot be applied as they are in the coastal districts owing to its peculiar geography. However of late people are finding it extremely difficult with regard to land conversion. Add to this the confusion regarding Form No 9 & Form No 11. People are literally facing an upheaval task even to own a few cents of land.


What are Form 9 and 11?

These forms are issued by the Village Panchayat after the conversion of the property has been done which contains the Khatha and Assessment in Form No 9 and the Mutation Entry evidencing the transfer of Khatha in Form No.11. If there is a building or development in the proposed land, then additional stamp fee must be paid at the time of registering the land. However now the Village Panchayats cannot issue these Forms unless a Non-Objection Certificate (NOC) is availed from the urban development authority. This is quite impractical as people who own just 10-20 cents of land are made to make several trips to the Urban Development Authority to procure the NOC. Further this also involves substantial expences which come as a burden both for buyer and seller.

Since more than 40% panchayats in the coastal districts of Udupi and Dakshina Kannada come under Coastal Regulatory Zone (CRZ) and also due to the absence of any ‘Gramathanas’ (non-agricultural land) among any of the panchayats in Udupi districts, the then district in-charge minister Kota Srinivas Poojary, through a letter dated March 18, 2013 had urged the Chief Minister to exempt DK and Udupi from compulsory implementation of Form No 9 & 11. Following this, the then CM Jagdish Shetter had directed the DC to exempt rural areas of both Udupi and DK districts from Form No 9  & 11. However with the change of CM as well as district in-charge minister after the Assembly elections, the order still stands far from implementation.

The former visionary chief ministers often directed the officials not to trouble commoner with rules and regulations. They even used to exhort the officials to propose any amendments in Laws in case such laws were increasing the hardships of common people. But today, the government offices and officials therein seem to have forgotten that their first and foremost duty is to assist and ease the trouble of the common people instead of confusing and frightening them with unnecessary clauses of Laws. There are hardly any government offices and officials who move with just one application. People need to make number of rounds to these offices even to extract a basic document or avail necessary information.

Former vice-president of Kunjal gram panchayat Rajiv Kulal says that poor who wish to build a house for themselves even on a five or 10 cents land, Form No 9 & 11 are requested. People cannot even sell their small piece of land to meet their urgent financial needs.

This law was earlier in vogue only in the Udupi Town Municipality and Town Panchayat limits. However it was then extended even to the rural gram panchayats. Such Laws are necessary but they should be implemented keeping in mind the local issues and must be simplified that commoner is not troubled, says Satish Amin Barkur.

Usually the governments issue populists orders keeping in mind the general public. However such measures may at times prove troublesome to the poor people, specially the ones living in the rural and remote areas. This is what happening with the strict implementation of Form No 9 & 11. The coastal people who usually own only a small piece of land unlike people of Malnad or other regions, find it difficult to abide by government norms. The issue must be brought to the notice of the revenue minister and concerned officials so that a solution is found at the earliest, opines Brahmavar Block Congress president Birthi Rajesh Shetty.

He further says that Udupi and DK districts do not boast of huge stretch of land which is good for development and construction. It’s a coastal belt and hence most of the times inundated even during non-monsoon season. Further the CRZ regulations are strictly followed making a lot of coastal areas uninhabited. So if the officials make Form No 9 & 11 compulsory, then this move may result in skyrocketing of land prices owing to the unavailability of land of construction and development. Ultimately the middle and lower middle class people may find it extremely to own their own land or house at affordable price, adds Rajesh Shetty.


Following measures might ease the present confusion and problems:

1. The mandatory 55:45 ratio with regard to the empty space within the housing layouts built in 3 acre or less land must be scrapped and instead it should be made mandatory that main roads and cross roads within the layouts at least 30 and 20 feet respectively keeping proper drainages on both sides of these roads.

2. In housing layouts carved out on less than 3 acres of land only a 5-cent land should be earmarked for utilities such as gardens, transformers, segregation

3. The properties which are yet to be sold but have been converted before June 14, 2013 and those who build RCC houses for their personal dwelling must be given exemption from Form No 9 & 11 rules

4. Even if the law is to be implemented, it should be directed that people are allowed to take all permissions only from their local gram panchayats and are not made to visit Town Municipalities or Urban Development Authorities

5. The exemption must be continued till the details of the earmarked ‘Gramathanas’ are made available in all the village panchayats.

    When high court can issue clear cut verdict about single site layout. It become very difficult to purchase or sell plot in Udupi. May some body listen our problem and find solution to it.

    please take a serious note of the following
    1.if NRIs are buying,who is selling?
    2.if NRIs are selling,who is buying?
    3.i am an NRI,in my last vacation,i have had 45 lakhs free,lying in bank.a broker came to me and said,why not you buy a land in Udipi.i said,why? he says,its a good investment.what about locals who want to buy a land,who have to pay 13% interest and get a loan to buy a piece of land? he says,forget about that,you have 45 lakhs in bank,just bring it out and buy this property.next year-we will sell for another NRI for 60 lakhs.you make 15 and i make 2 2% (Buy and sell).
    he did it.

    conclusions:
    NRIS,especially software,medical,engineering professionals are not buying land in udipi.locals are creating a Hype and doing it themselves.

    Former president of zilla panchayat (ZP) Bhujanga Shetty. Famous know for cheating people and chnaging papers to help the rich and black money buyers.. laws are made for a reason . How many property papers in brahmavar are chnaged over night . the reporter has to check with Udupi TQ. Both with Brahamavar and Kundapur Tasildars mafia.

    All the Builders and Brokers are also powerful members of either BJP or Congress. So, their work goes on smoothly in our districts. It is only ordinary people who are facing lots of problems in sale & Purchase of even small piece of land. Builders mafia is behind this introduction of cumbersome procedure, because they want to discourage the middle-class people from purchasing small piece of land and building their own house, so that the demand for the ready flats of big builders will increase.
    BJP lost election of Mangalore City Corporation only because of such cumbersome Laws implemented to stop people from buying small sites and push them towards purchase of ready flats of big builders. But Congress has not learnt a lesson from this.

    The people who are mainly responsible for such steep increase of price of properties in Mangalore & Udupi are the NRIs who are thoughtlessly making huge investments in Land & Flats as if entire land in DK/Udupi is going to exhaust shortly. Brokers & Builders are making tons of money easily because of these short-sighted NRIs.
    In fact plenty of Land is available in Mangalore & Udupi districts, and if the NRIs stop buying just for six months then land prices will crash by 75% within few months.
    Anyway because of resistance for Niddodi Power Project and SEZ the industrial growth in DK-Udupi will be stunted, and all those NRI & Mumbai people who have purchased land with a hope of steep rise, have to sell the same at large discount by next year.
    Of course the strict Law for sale & Purchase of Land is a welcome measure.

    Ramakrishna - Mangalore you are right. The Vacant Land available in Mangalore & Udupi is so vast that it is sufficient to build Two Bangalore Cities. The NRI & rich people are foolishly investing in land in DK & udupi foolishly thinking that Land is scarce. They will repent for it shortly .

    Yes sir your comment is very sensible and apt!! Indeed, NRIs and other businessmen flush with extra money are thoughtlessly investing in properties Mangalore/Udipi areas thereby creating an artificial jack up of prices!! There may be hardly few end users remaining all buy as investments!! With the current shaky economic scenario the crazy buying should cool off and land prices correct substantially!! As you said there is absolutely no justification of sky high prices in this area and it is only the NRIs and those with huge amounts of black money who are able to do this and not the aam aadmi!!

    I feel govt should be stricter and appreciate the present rule followed by udupi district administrator..
    It is not people interest to sell their property, It is brokers who cultivate greed in them...The pressure is not from the overall citizens the pressure is only from the real estate agents...Because of the rule they cannot sell the property in high margins. they are only the reason for this.. they made people suffer by increasing the land price sky high now govt should act in stricter ways possible..
    Agricultural land should not be given in selling and make buildings..
    It is necessary the people who build up inidvidual houses in thier own land should also have to leave the space while building the compounds future it is necessary for purpose of building roads or sewage lines etc... I wish govt will not loosen the present rule

    VERY GOOD RULES IMPLEMENTED BY THE GOVERNMENT. TODAY MIDDLE CLASS OR A POOR PEOPLE CANNOT BUY A SMALL PIECE OF LAND IN UDUPI OR MANGALORE. THIS IS BECAUSE OF BROKERS WHO ARE BUSY IN MAKING MONEY. THIS IS VERY WELCOMING DECISION BY THE GOVERNMENT TO MAKE SOME HURDLES. THE BROKERS AND BUILDERS ARE RESPONSIBLE FOR THE LAND PRICE HIKE. I URGE MORE STRICT RULES BY THE GOVERNMENT TO CONTROL LAND PRICE HIKE. LAND SELLING AND BUYING IS NOT A PERSONAL MATTER. THERE SHOULD BE SOME CONTROL BY THE GOVERNMENT. EVERY BUSSINESS HAS CONTROL FROM THE GOVERNMENT WHY NOT FOR PROPERTY?

    TODAY SELLERS IN UDUPI & AND MANGALORE SAYING 10 LAKHS PER CENTA IN CITY AREAS AND 2-3 LAKH PER CENTS IN RURAL AREA. IS THIS THE RATE OF A LAND WHICH CAN BE PURCHAED BY POOR AND MIDDLE CLASS PEOPLE?

Prasad, you are right which common man or middle class person even afford to buy land at 2-3 lacs per cent or flats costing 50 lacs and above other than those flush with funds like NRIs and black money holders who are investing not for end use but expecting fast appreciation!! And is the land worth that much in the first place is the big question!!

    The paper work in Mangalore too is cumbersome. One has to run from pillar to post to get the job done , which actually is the job of the Tahsildars / DC's office. we pay the fee and spend time to see that the files move. Actually, what is the big difference between the Congress & BJP . Both make the public suffer for their fault, for not updating the records after the 'J' slip is sent from the Sub-Registrars office. They have charged mutation fee during the Registration of the Document, even in the old days, yet done nothing. A PIL should be filed in the High Court.

    Law was there , but agents (of officials)told to break the law taking bribe.Same old law but now without bribe.This law will protect the buyer. Now land is expensive, people must not buy illegal land govt protects them, from tomorrows litigation. without proper records & proper legal
    road approach if you buy , the buyer will be looser. Always follow law its better for everybody.

    Very good article, Govt officials must not interfere and poke their nose with anybody's personal things like buying and selling lands for which we are paying the taxes. Irrational attitude of concerned officials shows their rude and corruptness.

    A good article to highlight the plight of the land owners in selling the land. Sack the officials who are irrational. The laws in udupi are applied with retrospective effect, i.e lands converted and sold prior to 2005. Why not apply it to Bangalore,Udupi and other cities where roads are narrow, parks are not left out etc. the officials claim that the law existed even before 1979. where are these laws applied to other cities. Let the Government concentrate on the cities first and later to rural and sub-urban areas which have another 100 yrs to grow. Send this article to each and every Government Officials at Bangalore and our MLA Madhwaraj and Ministr for Urban Development Mr sorake for opening their eyes wide open.

    This is a right article, these government officials made life miserable of common man.Some wants to sell the property for their daughters marriage, higher education etc., but they cannot do it. This rule must be simplified or scrapped.
