Udupi: Policeman accused of assaulting GP president over issue of flag

Udupi, Nov 25: A circle inspector has been accused of allegedly slapping a gram panchayat president on the night of Sunday November 24, over an issue concerning failure of officials to lower the national flag at the end of the day as per protocol.

It is said that the driver of Kote gram panchayat president Prashant Jatanna was on his way back after dropping him home, when he noticed the national flag at the panchayat office not lowered as per protocal. He then stopped the car and informed Jatanna, who asked him to captura a few photographs of the flag on his mobile phone as evidence, and lower the flag himself.

Meanwhile, circle inspector Sunil Nayak who was night beat noticed Jatanna's driver and enquired what he was doing. The driver explained his action, but soon an argument arose between them over whose duty it was to lower the flag. The inspector reportedly said that he has no right to lower the flag, for which the latter replied that anyone could do it, as long the flag was given due respect. The driver then called Jatanna, who arrived at the spot. Soon, people gathered and the situation turned tense, and more police personnel rushed to the spot to control the crowd.

Speaking to mediapersons in the hospital on Monday November 25, Jattanna alleged that the inspector talked rashly to him and assualted him, for which he had to get admitted.

"He knows I am president of gram panchayat, how could he raise his hands on me?" he said.

DySP Annamalai of Karkala too had visited the spot and Jatanna was taken to police station but released soon. He then filed a complaint against the inspector for insulting the national flag and assaulting him. He also demanded his suspension or transfer.

Jatanna's wife who was present in the hospital said that the police who should be protecting the people has created nuisance for her husband.

Speaking to daijiworld, Karkala DySP Annamalai said that there was no question of inspector Sunil Nayak's suspension. "At 11.30 when the incident took place there was no one at the spot except the persons directly involved in the incident, but gradually people started gathering. We wanted to depute more personnel to avoid any untoward incidents," he said.

"Inspector Sunil says that he has not assaulted the gram panchayat president. He will file a case against Jatanna for insulting the national flag. The inspector said that Jatanna was not trying to lower the flag but only clicking pictures to complain later. He should have first lowered the flag. No one can insult the national flag," he said.

He further said that he would be investigating the case on three aspects - whether the national flag was insulted, whether gram panchayat president was assaulted and whether there was dereliction of duty by panchayat officials in not following protocol with regard to the flag, and if so, by whom.

When it was pointed out that Jatanna was admitted in hospital, the DySP said that he was not admitted but had only gone to check his BP and sugar, and that there are no hospital records to support the gram panchayat's claims.

Meanwhile, chairman of International Federation of Karnataka Christian Associations (IFKCA) Ronald Colaco condemned the incident and said that police shoud maintain law and order and not take law into their hands. He pointed out that when gram panchayat president had already taken action to solve the matter, the circle inspector should not have assaulted him. "The DySP is trying to twist and fabricate the case. I tried to contact district incharge minister Vinay Kumar Sorake but there was no response. I then spoke to the ADGP and explained the situation to him. Strict action must be taken against the circle inspector, if not it will send a bad message to the public," he said.

IFKCA state convener Denis D'Silva also condemned the incident.

    I have very bad experience with Kaup police.ASI Purushottam misbehaved with me in expectation of some money 6 months before and threatened of arrest me for a small road accident done by another vehicle to my vehicle.Still our police system in 1947 without any changes.

    This circle inspector is pakka lier and currupted man, now he is boosting in public saying that I don't care about my transfer, I am ready, I request SP, he should transfer immediately otherwise entire Kaup area will go on strike also Karkal DSP supporting his man, these police will think when they put KAKI dress they are the supreme so they can do anything. he his uncultured and uneducated circle inspetor, let us wait and see.

    Was there any need for the police to create this commotion and scene? Instead they could have helped the driver in lowering the flag with all due respect, if not CI could have done himself. Just wonder why police should act like dictators and resort to these unruly behaviors when they are ACTUALLY public servants. This is called “misuse of power” or "ADHIKARADA MADA".

    Being this incident has happened at night, quite naturally, the police will be less charged. But once the SI knew the real situation, he should have opted to help the driver to lower the flag ( if not mistaken, at night the National flag should not be hoisted).
    Rules are meant for protecting the citizens but even here, the flag, if it would been lowered at night in a discrete manner, nobody would have bothered. Are we Indians in general are good in creating unnecessary issues, blame game, wasting our own energy with no productivity & results.

    Wish this issue will be settled in the right spirit, upholding the dignity of all the aggrieved party.
    Support to each other will lead to better society where as confrontation attitude breaks the peace of mind in the society.

    In all the government offices the flag must come down at dusk. However after a PIL from Naveen Jindal that the flag may be hoisted on all day, the court ruled that the flag may indeed be hoisted on all day, including on government offices. We see a lot of people still not properly aware of the rules of patriotism, which includes our national flag. Jathanna must have been aware that there was no need to lower the flag. And moreover even the police seem to be unaware of this court ruling. What a tragedy

    Dear Main Issue is not about lowering the flag, it is clearly mentioned police was not allowing the driver to lower the flag, Being a President of gram panchayat it is the his right intervene into the matter as it is the protocol to lower the flag. & taking the picture is not insulting the flag, as its not crime to taking the photo of the flag. Police brutality is the very common in Karavali area that too on the minority.

    Section 6a: "It is the universal custom to display the flag only from sunrise to sunset on buildings and on stationary flagstaffs in the open. However, when a patriotic effect is desired, the flag may be displayed twenty-four hours a day if properly illuminated during the hours of darkness

    Most of my time I stayed in Dubai. But when I was in Kuwait I found that every evening the some embassies were downing the flag. When I asked my friend who was working in American embassy he told me that lowering the national flag at the end of the day as per protocol, and if you are not doing so it is a criminal act. But this protocol is not followed in most of the countries and found that once hosted flag is not at all attended/removed.

    The police need training and counseling on the subject on how to deal with the public. In India every police personnel including the so called honest officers, have a phobia of power in their hand. The police power is like a hysteretic drug and they cannot change until they remain in duty.
    The public always hates the police personnel for their strange behavior and this behavior cannot be changed unless the police go through a intensive regular training to change their attitude.
