Karnataka passes ESMA Bill: Striking work to be non-bailable offence

Belgaum, Dec 4 (PTI): Striking work will be a non-bailable offence and police can arrest a striking employee without warrant under the Karnataka Essential Services Maintenance Bill, 2013 passed by the Legislative assembly here today.

The bill, popularly known as ESMA, is to put an end to employees working in water, power, health, transport and service sectors going on strikes, inconveniencing people.

As per the bill, the definition under ESMA for essential services include any service connected with the production, generation, storage, transmission, supply or distribution of water or electricity and any transportation service for the carriage of passengers or goods by motor vehicles.

It gives government the power to declare even those services that the State has powers to make laws for under List II of the 7th Schedule of the Constitution, as essential services.

Upon conviction, those who commence a strike or continue to go on strike or takes part in any strike will be punished with a sentence up to one year or with fine up to Rs 5,000 or both. Those instigating or financing strikes also face the same punishment.

Those giving financial aid to illegal strike also will be booked under law. The order will come into force for a period of one year from the date the government publishes the order. However, it can be extended up to six months.

    This is a very good bill, congrats to our Chief Minister..unnecessary strikes were causing huge loss for the nation and the same thing should be applied to religious parties who celebrates their congregations on the road disturbing the whole system.,that is very bad, whether Hindu or Muslim ,, it should be banned strictly. Enjoy your feast in temples, masjid and in the homes..... Finish. Not on road.

    This is a welcome note! But at the same time these legislators make rule for others to follow not for themselves! They keep wasting their precious time during sessions by disturbing the proceedings or by walking out. Who will discipline them? They also should be brought under ESMA!

    Every now and then I find striking, road block in Mangalore. I used to wonder how the city will grow with this. At lesat Siddu Government has come forward to stop this Nonsense.

    One more path breaking law by the state govt. This will surely put an end to uncalled/politically motivated strikes where the general public is most affected.
    We need a structured , rational way of putting forward our demand, not by committing suicide or staying for the week long dharna!!!

    MLAs & MPs work do not fall under essential services. Whether they attend the assembly / parliament sessions or go on sightseeing tours, do not make any difference in the lives of common man. So they easily escape from the ambit of ESMA.

    Now no one is entitled to talk about their employment rights under Govt Departments. They will be arrested if they raise their voice against injustice. If this works out CM Sidda should present a Jail budget to construct Jails across Karnataka to keep the people who participate in Strike. Better to withdraw this bill and provide necessary facilities each and everyone according their work..
