Mangalore: PUCL alleges forcible eviction by SAC, college clarifies

Mangalore, Dec 5: The district unit of People Union for Civil Liberties (PUCL) led by P B D'Sa on Thursday December 5 held a protest at the entrance of St Aloysius College (SAC) at Lighthouse Hill, alleging that the college was trying to evict a person from his house. the college, however, has denied the allegation and clarified that the said person had been illegally occupying land owned by the college.

The protestors distributed pamphlets to students and public during the protest.

The pamphlet stated, "57-year-old John Baptist Lewis, the adopted son of Alice D’Souza had been living with Alice D’ Souza in peace and harmony since 40 years, having married three and bringing up two children who are now 19 years and 22 years, at door No 14-1-49, 49a Court ward, Patrao Lane Karangalpady, Mangalore.

"All of sudden, the rector of St Aloysius College has started claiming ownership of the house and started using goonda methods, by discontinuing power supply and water supply," it stated.

"Baptist now fears that (the) priest may even demolish his house, when he is out at work. The family is now living without water and power supply. The priest and his men have criminally trespassed into house and locked the house which was open by the police and (the) priest was directed to have an amicable settlement. But the priest was adamant and warned them to vacate.

"The demand of Baptist Lewis is to allow him to live in a portion of the house or allot a proportionate area to live (if) they are planning for a new building. He is not claiming the entire property."
 
The pamphlet further stated, "PUCL tried to meet the rector as well as the Jesuit Provincial who stays at Bangalore and tried
for an amicable settlement. But the Rector seems to be bent upon having a forceful eviction."
 
On this occasion Savitha Benedict Louis, Melita Louis, John Baptist Louis and Francis Fernandis were present.
 
As the protestors gathered at entrance of the college, the gate was closed and students were diverted to another way.


College clarifies

In a press statement, St Aloysius College said that John Baptist Lewis had been illegally residing in the college premises and refusing to vacate despite repeated requests. The statement reads as follows:

"On Thursday, December 5, a group of people led by P B D’Sa, the president of the Mangalore branch of PUCL, demonstrated in front of the college entrance, holding placards and distributing pamphlets with baseless allegations. The protest was held to demand ‘justice’ for John Baptist Lewis. When the college administration came to know that the protestors were trying to trespass the college premises, obstructing the entrance by keeping placards against the wall, the college authorities tried to clear the way. When they were trying to do that, P B D’ Sa and John Baptist Lewis attempted to manhandle the staff and the students and also used foul language. Fortunately, the police who were present at the scene gave protection and tried to calm the situation.

As clarified earlier, the college administration once again wants to reiterate that John Baptist Lewis has been illegally residing in the college premises and refusing to vacate, despite repeated requests. A series of negotiations to this effect also have not borne any fruit. the college has done no injustice to him and has all the documents to prove the ownership of the property which John Baptist Lewis has illegally occupied. the college is only trying to protect the property which lawfully belongs to it and has no other ulterior motives. Trespassing the property of the college using highhandedness is not in keeping with the law of the land."

    At this point SAC should designate any priest from college along with another 2 lay members of community either from Sacca or their well wishers and should give a opportunity to meet Mr Lewis exclusively and find out what is there in his mind.
    Maximum, they can involve his wife and take her opinion too so that to settle this issue amicably.
    I am sure if the compensation is increased a little more, the family who lived in the shade of these institutions will certainly agree for this mediation instead of continuing the matter, as they too have to concentrate on their children's studies and welfare.
    Some one should take this initiative and proceed to approach the said Mr Lewis and convince him the time and cost taken to settle this matter in the court.
    By the strength of the will of the deceased , SAC can proceed with any developments on the property and if at all court can consider only on the quantum of compensation if any and this may take at least 10 to 12 years time as per the present situation of pending court cases.
    This fact may please be brought to the knowledge of Mr Lewis, which he may not be aware of

    Sad to hear about the forceful eviction by the priest. Why not do it in a lawful way. Priests are supposed to lead by example and not merely preach, when by-self don't practice and promote peace and harmony.

    As human nature is weak, God only can give the accurate verdict.
    It is really unfortunate to get the opportunity to fight for justice from an institution which has enlightened the minds of enormous students, with excellent education and scattered them all over the world to lead a respectable life.
    Where are the talent and wisdom of the person who lived for several decades in the doorstep of this wonderful temple of education?

    Time and again many people manipulatively use some organizations for their benefit under the guise of injustice.

    Like for instance in Mumbai whenever some employee gets fired from their job for their fault they are quick to approach Shiv Sena/MNS etc who take up their cause for their benefit too. Like in Delhi where Jethmalani takes any case against Congress, Mr D'sa jumps whenever an opportunity arises against the priests.

    The so called victim is manipulatively using PUCL by crying injustice. It is nothing but encroachment and he is allowing his children to continue thereby trying to legitimize a land that doesn't belong to him.

    Instead of being grateful to the priests for giving a opportunity for education it is time to move out after that and build your own home outside. Leave that land for better utilization for prospective students in the right hands.

    There has been a lot of talk in Mangalore in this issue. Most of the people opine that the person who has been staying in this house for nearly 40 years with his family is not even offered the sale price of 1 cent of the land in question. St. Aloysius College has a glorious history and it would be a great injustice if they do not offer a decent compensation. I appeal to the Management to settle the matter at the earliest. If Mr John Baptist Lewis accepts, then how about providing him a 3 BHK Apartment in Mangalore. He is not all alone but has his family with him. What can he buy for 5 lakhs. I am sure, Mrs Alice D'souza will be watching from above and wouldn't expect injustice to John Baptist who has taken care of her.

    Please settle the issue at the earliest and stop all the damage to the Institution name. If it cannot be settled, then a committee consisting of Management, Old Students and well-wishers could be appointed for arriving at a solution. As per the law of the State, thousands of Acres of land have gone to the tiller of the land and here he is asking only for a decent settlement.

    Dear Rev. Priests.
    You never bought that land as you say it is donated to you. Then what is wrong with you to donate a small portion of land to John and his family and you people can built a decent house for him to live with his family. Are you people going to lose anything? Please think yourself. What have learned in the whole priesthood life? What is the teaching of Jesus? You never practice what you preach from pulpit. (We get very few and rare priests who preach and practice and they are suppressed by other priests) have you forgotten teaching of Jesus? and now it looks like you are making mockery Jesus teaching. Think from your HEART and not from your MIND. The most of the property you have it is donated by someone and it is not purchased by any one. Those who donated the property thinking that priest will do something for fellow being now it is vice a versa.

    This is some very reliable information. The College authorities do offer Mr. Baptist compensation as mutual settlement which Mr. Baptist refused.

    57-year-old John Baptist Lewis, never been the adopted son of Alice D’Souza as per record. If not mistaken. infact in 1980's during the tenure of Rev Fr Rony Prabhu, who was the Rector that time, this property has been through will by Ms. Alice has been done, in the name of St. Aloysius Institution.

    Here in this case, Mr. D'sa has been been ill informed. We should appreciate the St. Aloysius Rector for giving so much time for Baptist to make an alternative arrangement.

    Hope College authorities and Baptist will come to the negotiation table and settle it amicably. It seems, if not mistaken, Mr. Baptist require more compensation than what college offered him.

    If JBL is staying on a property illegally, then it is the duty of SAC to evict him through legal means. There is no need for negotiation or using force. The statement of PUCL and SAC does not mention anything about legal methods to settle this issue. How come SAC after 40 years thought of this property and were they sleeping for 40 years. This issue has many loopholes which does not connect.

    how good are they at civil right at the Civil Liberties (PUCL)I do not know but priest received freely must share freely, not with others at least with poor John and his family having spent 43 years. He served the family of owners while suffering or dying while SAC did nothing. Share at least 10% of total value out of many crores and not just 5 lacs.

    You never bought that land but was donated. John was residing in that house over 40 years by the permission of the same owner. Tiller of the land is the Owner of the land. Since both of you never spent for the land, solve in a amicable Christian way, Give and Take. Let you have the rights of the land at the same time John also has the right to stay some portion of the land. Rector nor SAC are not poor but John is with no hope with alternative land, have mercy on him as you teach from the pulpit Mt. 5: 3-8.

    No priest has the right to donate any land donated to them because the land has been donated for the purpose by the donor.
    Eg...retreat house for retreats.(not parish)
    Central maidan for sports ( no buildings )
    A grandson of the donor.
