Kuwait: Truth prevails - Two years after arrest, Melwin Fernandes declared innocent

Kuwait, Jan 29: In a heartening news, Melwin Fernandes, who was jailed in Kuwait for unknowingly carrying banned medicines and released eight months later, has now been absolved of all charges and declared innocent by the Kuwait court.

Melwin, a native of Karkala, had been arrested by the authorities at Kuwait airport on February 9, 2014, for carrying and possessing the prohibited drug tramadol used as a pain killer. The parcel had been given to him by the wife of Richard Castelino to be handed over to the latter in Kuwait.

Melwin's wife Carol fought hard for her husband's release, with the support of several associations and individuals. After Carol's unflinching efforts that included approaching the Indian embassy, the state government, the Indian government and other authorities, Melwin was finally granted bail and he walked out of the jail in October 2014. However, the case was still in court.

Now, Melwin has been cleared of all charges by both first and second courts of Kuwait and moreover, he has not been banned from re-entering the country. This means, Melwin can return to Kuwait and continue to work there.

Sources said that Melwin, for whom the court pronouncement has come as a huge relief, would be coming down to his native Karkala very soon.

Indeed, Melwin's acquittal is a great news for all concerned, his friends, family and community associations and most importantly, his wife Carol whose determined efforts to prove her husband's innocence deserve huge applause.

    Thank God he can go back and work if he wants to the same working place without Problem.Otherwise other countrys are not allowing a Person who is stamped as a jailed,or carried drugs etc.to enter,even he is d as innocent.It is a cat and mause Play.Anyway he is out and d innocent .Thats most important.Now he can throw the passport into gutter also and sit somewhere in a green place to breath fresh air.have a nice time ,Melwin.May be st.Lawrence brought you back.

    Lord alone knows how many people and how many times compassionate souls have done similar acts without knowing what they carried for friends and relatives. Hopefully the senders will restrain from doing this in future and use courtiers and other avenues available for such needs. By and large carrying prescription drugs for others is not acceptable in most situations.

    God bless you Melwin and Carol. I can say its only because of Carol, Melwin got released from jail. There are so many organisations, Govt. authorities and individuals to help, its we how much interest we take in approaching them for their help for GOOD causes like in Melwin's case.
    To summarize this case, friends do not carry anybody's parcels. Even Masala like Kaskas (Poppy seeds) is banned in most of the gulf countries. to buy Kaskas Dr. prescription is not required, but if you take it to gulf you will end up in jail for sure.

    Indeed it is heartening to have heard of your release and now that you have been cleared of all charges is a welcome step in you carrying on with your life.

    You can most certainly forgive, but it is hard to forget especially for those who were on the other end of the stick this is a sensitive issue and the scars will stay for a very long time to come.

    So I would ask those in the forum to please comment sensibly and never ever, ever carry parcels for anyone.

    Be immensely thankful to the authorities there that he was released, most probably, on humanitarian grounds!! Legally after doing a mistake you can never escape saying that 'I did not know it was a banned item or by saying it is somebody's parcel', one stands responsible for the mistake, though one is really innocent!! Moreover it is an autocratic nation, and the laws are ruthless so he getting released is a miracle thanks to the relentless efforts of his wife and all those who took up for him!!

    Melwin and his family should rejoice over the final decision of the Kuwaiti Government to prove him innocent of all charges enforced upon him and imprisoned him for two years.

    Melwyn and his family, regardless of their financial and domestic situations should take a long break from their career assignment in Kuwait. That will bring them a mental and psychological relief after two years of imprisonment.

    This is one way to show to the Kuwaiti officials that prevails with or without the career opportunities in Kuwait. There is no substitute for mental peace and harmony.

    Hi there,read and saw few comments.First of all all credit to Melwyn's wife Carol to fight for acquittal of her husband and really appreciate her efforts.It is nice to hear Kuwait court has given justice.As specialist doctor who prescribe Tramadol to my patients everyday,it is not a banned drug in UK or US or in India.May be Melwyn's friend's wife did not know that Tramadol is not a banned substance and did not hand over the drug deliberately.In India one can get Tramadol in every drug or pharmacy counter and I think India should regulate the use and dispensing of these sedative analgesic drugs.Any drug is handed over to public with out valid prescription of the drugs.May be it is lesson for Indian pharmacy and Govt where drug is dispensed unscrupulously.

    Tramadol is a controlled drug(schedule) in USA. A physician evaluation is a must before some one can get a prescription.
    We all have to learn from this unfortunate incident- do not carry any medicines to anyone. All medicine should have a label with your name. In India Pharmacies dispense medication without a label. All medications should have the label with date, name, patients phone number, Pharmacy address and phone number.
    Crocin, Brufen, Vitamins, Fish oil can be carried without risk as they are available over the counter.
