Udupi: Court Orders to Reinstate Dismissed Lecturer of Brahmavar

Udupi, Oct 22: “Reinstate the dismissed history lecturer Prof Emmanuel Lalith Kumar immediately”, ordered the Court to the OSC Educational Society which runs the SMS College in Brahmavar.

The court arrived at this judgment, after taking into consideration the facts of the case and finding that the order of dismissal by the management had no specific base and that no enquiry or reason had been assigned for dismissal.

The court therefore while sternly admonishing the management for making a serious error which no Court can tolerate said that it being the protector of interests of the employees should apply its judicious mind to the facts and circumstances of the case. Further it advised that it should give sufficient opportunity to its employees.

The Court felt that the management has violated the provisions of the Karnataka Educational Act 2003 and so remarked that the latter has taken a ‘hasty and nasty’ decision.
