Mysuru, Jan 15: The second additional district and sessions court here, on Tuesday January 14, adjourned hearing of the bail application moved by Nalini Balakumar, who has been accused of holding 'Free Kashmir' placard during the protest held inside the premises of the University of Mysore.

Anand Kumar sought time to file objections to the interim bail sanctioned to Nalini Balakumar. Therefore, hearing was posted to January 20.

Nalini appeared in the court on Tuesday morning along with her parents. The lawyer who had filed Vakalatnama on her behalf was not present then. The judge who began proceedings, asked the public prosecutor to file objections. The public prosecutor sought time to file objections relating to the case of treason registered against the lady. The judge upheld his request and adjourned hearing.

In the meanwhile, Mysuru district Bar Association has decided against defending Nalini in the case. The lady, when she came to the court, expressed anger at the presence of the media and shouted 'No Humanity' at them.

    I think, she simply meant 'free Kashmir from the present sad situation.'

    If this is the attitude of the lawyers who are judgmental even before the trial has begun, then the court should acquit as the trial was vitiated as she could not present her case properly. The lawyers should recall Article 22 of the Constitution, which provides that no arrested person "shall be denied the right to consult, and to be defended by, a legal practitioner of his choice".

    When a similar call was given by the lawyers of the Mumbai Bar Council in the Kasab case: In the words of the then CJI Justice Balakrishnan in the Kasab trial: "To fulfil this constitutional mandate, the CJI says, the trial court would do well to appoint a lawyer to defend Kasab. It is now the onerous task of the trial court to scout for a proper lawyer, either from the legal community or from those empanelled in the State Legal Aid Committee."
