Bengaluru: SC/ST reservation in promotions - SC quashes review petition again

Bengaluru, Jul 31: The Supreme Court has again dismissed a review petition on the judgement of the Supreme Court on the issue of giving promotion to SC/ST employees based on reservation criteria. The petition had questioned the validity of a law brought by the Karnataka government in 2018 in the matter of promotion based on reservations to nullify the effect of the Supreme Court judgement.

This was the second review petition to have been filed against the said state act. The Supreme Court had delivered its judgement on the earlier petition on May 10 last year. The review petition was preferred by over a hundred general category government employees led by B K Pavitra and others. A two-member bench of the high court led by Justice U U Lalit however, has dismissed this petition.

When the employees had originally questioned the validity of the reservation-based promotions, the Supreme Court had held that promotions based on the reservation were wrong. The state government had passed a bill approving reservation-based promotions. It had said that the status quo would be maintained in case of earlier appointments, and the order of the Supreme Court would be applied to fresh appointments.

The validity of this decision was questioned through a review petition but this effort of general employees has failed again.
