Bharathi Urs Acquitted of Murder

She was accused of murdering Chitralekha over financial dispute 6 years ago

Bangalore, May 28 (DHNS): Bharathi Urs, daughter of former Chief Minister D Devaraj Urs and accused of murdering her cousin Chitralekha Urs over financial disputes six years ago was acquitted along with two others in the high-profile case by a Fast Track Sessions Court here on Thursday. 

 The sensational murder trial of Chitralekha, daughter of former High Court judge M P Chandrakanth Raje Urs, finally reached its climax when K Amaranarayan, I Fast Track Sessions Judge, pronounced the 105-page judgment.

Observing the two crucial prosecution witnesses, the watchman and the peon of Harikhode Palm Grove, a guest house on Palace Road where Chitralekha was reportedly murdered between 6:50 and 7 pm on January 19, 2004, Judge Amaranarayan said evidence does not indicate even remotely that Bharati Urs committed the murder.

Also acquitting the other two accused, T Madhukar and L N Chandrakant, the judge maintained that the witnesses had said that they never saw the accused.  The Judge also refused to accept the theory that the conduct of the accused was “unnatural”. She had been very close to the deceased and she would often visit her house. It shows that the two were more like friends, he observed.

The Prosecution had contended that Bharathi had, at first feigned ignorance about the Chitralekha's whereabouts and later asked the family of the deceased not to file a complaint after she went missing.

Defence counsel C V Nagesh, however stated that Bharathi said so in view of the social status of the family. The court while taking this into consideration held the three accused not guilty.

Delay

The famous case underwent several delays. The trial alone was put off three times, on October 4, 2005, January 20 and March 1, 2006. It finally began on May 29.  This apart, about three to four judges heard the case before Amaranarayan wrote the judgement. Further, the date for pronouncing the final verdict was also put off once.

In all, 68 witnesses including Chitralekha's elder sister Hema Mandanna, her husband Ashok Mandanna, her mother Sharada Urs, and her second sister Nayan Tara, deposed before the court.

Chitralekha had gone missing on January 19, 2004. When she could not be reached over phone, the family filed a missing person's complaint with the High Grounds police station. After 50 days, police arrested Madhukumar and Chandrakanth and traced the body in Shiradi Ghat in Hassan district.

Chitralekha’s identity was established based on a DNA test and jewellery she wore. The family's doctor confirmed the identity on the basis of the root canal treatment. Subsequently, the three were arrested and remanded to judicial custody. The Prosecution contended that Bharati Urs had hatched a conspiracy to murder Chitralekha as she had borrowed about Rs 70 lakh and failed to repay it. Further, T Madhukar and L N Chandrakant  were charged with committing the offence for money and destruction of evidence.

Expressing disappointment over the ruling, Nayan Tara said: "We are deeply shocked and extremely saddened by the verdict.  It is a sad day for justice. We were absolutely sure of a conviction because of the overwhelming evidence available on record.  We shall fight until the end and we hope that justice shall prevail ultimately." She said the family planned to file an appeal before the High Court. "We will see to it that the Prosecution also files an appeal," she told

    Regarding Jury system it was there in post independent Indian judicial system. It was abolished by HON.Suprem Court of India due to undue influence from third parties on juries. ( Ref:K. M. Nanavati VS State of Maharashtra 1959 )

    I know US judicial system is fair. But in that also several BLACK SPOT are there. So many HOLYWOOD movies created based on US Judicial system ( eg: The Hurricane (1999 film)

    LACK OF EVIDENCE !! NOT A SURPRISE ! Then, why Bharati was kept in jail for 6 years ? We have ONAKE OBAVVA'S or OBIRAYA's period rule and system. Actually Bharati was strongly suspected by all in Chitralekha's murder.

    Thank u Mr Langoolacharya for enlightening me about U S legal system. But where I used loose language I don't know, but I find in your reply a lot of it.

    Please read in past Reader's Digest, how stinking their legal system was, how they framed innocent people with Sheriffs in the pocket of Drug lords,probably u are ignorant about how many were convicted & were electrocuted wrongly,how Big Tart Lawyers work, etc.

    My intention was simple to show our legal system still in British pastways is deficient, while the advanced U S legal system too is lacking compared to us.

    Our P M Indira Gandhi was sent to jail by our legal system, while U S legal system lets whites with lenient punishment, but coloured people are punished severely. Kennedy's brother was let off for raping, while Mike Tyson was sent to jail for the same crime-which ruined his career which was in prime form at that time,please ask any black who had suffered under US legal system. Please come out of your prejudiced mindset, & read my previous comment once again, I hope u will understand my point of view.

    In US we have jury system, there will be 6-12 members of public who will decide guilt or innocense...jury is ed randomly from a pool...judge is only a moderator in the trial...

    Its like your own peers will decide your fate...

    Now in olden days there was no DNA testing, so if they collected DNA samples then, they are processed now to find a person is really guilty...

    US judicial/police system is very fair, when George Bush was president of US his daughter was charged for drinking alcohol(underage drinking), now dont use loose language if you dont know the facts my friend...

    Nobody is above law in US, even president of US, in India perhaps a small time politician of Bantval thinks he is above law.....You wrongly think its same here my dear friend Sozam.

    Who then murdered Chandralekha, the state as well as prosecution along with COD has failed the people in finding the real culprits. With modern forensic science, why we don't nail the real criminals rather than subjecting innocent people as in the case of Arushi Talwar's murder.
    Now in U S they are reopening cases in which many convictions have taken place,the socalled perpetrators have suffered in the jails for 20 or 30 years, some have died, but their family members get the casese scrutinised by using modern technology to cross examine & verify the crimes- & now they are acquitted, can the state bring back their lost years, the mental agony & suffering they went through-no , never- but their family members can heave a sigh of relief, knowing that the black shadow handging on their past is lifted-God's justice is only the real justice it seems.

    I was sad to read that Bharathi Urs was dragged into a criminal case by vested interests,It is indeed shocking to read that the Great Devraj Urs's daughter is dragged into a murder case,It is almost like the Royals of the Great Mysore State who will never stoop to such low level of crime,The people of Karnataka will never forget your great father champion of the dalits and backward class people.Wish you best best of luck Bharathi
