Bangalore: SC Issues Notice on RTE Petition


Bangalore, Oct 3 (DHNS): The Supreme Court has issued notice on a writ petition filed by the Managements of Independent CBSE Schools’ Association, Karnataka (MICSA-K) seeking to challenge certain clauses of the Right To Free and Compulsory Education (RTE) Act, 2009. 

Admitting the petition, the Bench comprising Justice Raveendran and Justice Gokhale also directed the Solicitor General who was present on the occasion to assist it in the matter on behalf of the Union Government.

Besides, the Court directed that the said matter be tagged along with other matters where similar issues are pending and accordingly the petition would be heard by the five-member Constitutional Bench “very soon”, Rahul Dhawan of Lex Chambers, counsel for MICSA-K, told Deccan Herald over phone from New Delhi.

According to Dhawan, the petition seeks to challenge, among others, the clause on reservation of seats for children aged 6 to 14 in a private unaided school. He termed the rules in the said legislation “more draconian” and said the private schools were “not at all happy” with the procedure set for implementing the Act.
