We will see: SC on plea challenging Karnataka HC's verdict on hijab


New Delhi, Mar 16 (IANS): The Supreme Court on Wednesday declined to grant an urgent hearing on a plea challenging the Karnataka High Court order, which dismissed all petitions seeking direction for permission to wear hijab in classrooms and held that wearing of hijab by Muslim women does not form a part of essential religious practice in Islamic faith.

Senior advocate Sanjay Hedge, representing the petitioners, mentioned the plea before a bench headed by Chief Justice N.V. Ramana. Hedge said there is urgency in the matter, as several girls have to appear in exams. The bench, also comprising Justices A.S. Bopanna and Hima Kohli, said others have also mentioned and the court will look into the matter.

Hedge insisted that exams are starting and there is urgency in the matter.

The bench said it needs time and it will post the matter for hearing. After brief submissions, the bench said the court may list it after Holi vacations. "Give us time, we'll post the matter", said the bench.

The plea filed through advocate Adeel Ahmed and Rahamathullah Kothwal said the high court order creates an unreasonable classification between the non-Muslim female students and the Muslim female students and thereby is in straight violation of the concept of secularism which forms the basic structure of the Indian Constitution. The petitioners are Mohamed Arif Jameel and others.

The plea said: "The impugned order is also in sheer violation of the Article 14, 15, 19, 21 and 25 of the Indian Constitution and also violates the core principles of the International Conventions that India is a signatory to.".

It further added, "Being aggrieved by the impugned Government Order, as it is in violation of Indian constitution, the petitioner had approached the Hon'ble High Court by way of a Public Interest Litigation (PIL) Petition challenging the validity of the same.

"The High Court vide the impugned order has sought to curtail the fundamental right of Muslim student-women by upholding the impugned Government Order which bars Muslim women from wearing the hijab and pursue their education. It is hereby submitted that the right to wear a hijab is an 'essential religious practice' and falls within the ambit of the right of expression guaranteed by Article 19 (1) (a), the right to privacy and also the Freedom of Conscience under Article 25 of the Constitution. The same cannot be infringed upon without a valid 'law'."

Another plea, filed by two Muslim students, Manan and Niba Naaz, through advocate Anas Tanwir, said: "The petitioners most humbly submit that the High Court has erred in creating a dichotomy of freedom of religion and freedom of conscience wherein the court has inferred that those who follow a religion cannot have the right to conscience."

The plea contended that the high court failed to note that the Karnataka Education Act, 1983, and the Rules made there under, do not provide for any mandatory uniform to be worn by students.

    Even SC will not give justice to these girls in accordance with the constitution. The only way forward for them to go is Farmer’s Way. Sit in peaceful protest in front of the Karnataka state assembly. If possible invite foreign media.

    Yes it’s all politics now. These innocent girls have been brainwashed, instigated and encouraged by some fanatical parties. Even during our school days there were uniforms and all students strictly adhered to it. There was no talk of hijab, naqab or saffron shawl. Why? Because these radicalized organizations were non-existent in those days.

    Religious freedom is one of the most fundamental of human rights because religious freedom comes from the dignity of the human being as God's creature. Religious tolerance is something we should all practice; however, there have been more persecution and atrocities committed in the name of religion and religious freedom than anything else. What is going going on in Karnataka seem to be doing away peoples religious culture and personal choices in the garb of school uniform . Such realization cropped up out of the blues as if secularism/democratic norms are being slowly snatched to fulfil the desires majorities (Hindutva goal) Today one community and if the trend succeeds/continues, no one can guarantee which section of people standing in line to be a next victim

    "Sania Mirza did not wear any Hijab when she was playing tennis." Our Film industry produced so many Muslim Heroines and have you seen any one of them acting with Hijab and head veil covered. Rather the in 60-70 the mot sexy with Western attire girls like Zeenath and Parveen Babi used to be highly sought after actresses ! Hijab is a religious symbol for Muslim ladies like Turban (Pakdi) and growing hair/beard for Sikhs but our government keeps mum on Sikhs way of following their religious and cultural outfits. Why double standards. It's clear how straight forward the verdict given by High court. The will not stop here as long as Supreme court clarifies the matter based on our constitutional rights for minorities.

    There s a time and place to display your religious affiliation. Not on the Tennis ground where you are playing, nor in films when you are acting, or when you visit a place where there are strict guidelines/requirements. If a land where Islam was born and is holy for all Muslims allows Muslims to attend schools without a hijab, why do Muslims in India become holier than them just because the Constitution gives them the right to practice their religion. It is time that Muslims grow up and give equality to their women and keep them in bondage.

    There are many who consume alcohol, does prostitution, doesn't offer prayer does it mean every other Muslims should follow it by considering that some Sania, Rania,Amir,Sharukh doing this and that?? Islam is not followed based on what someone is doing. Islam is followed based on Quran and Prophets teachings.
