Impossible to stop ban on Muslim traders in temples: Law minister


Bengaluru, March 24 (IANS): Despite the posters of ban on Muslim traders in Hindu religious fairs and hue and cry by the Opposition Congress, the Karnataka government said that it is impossible to initiate action against those who are imposing ban on Muslim traders in and around temples in the state.

Minister for Law and Parliamentary Affairs J C Madhuswamy on Thursday said in the Legislative Council that it is impossible to initiate action against those who have banned traders belonging to faiths other than the Hindu religion, in the limits of temples.

Answering to the demand for initiation of action against those who are imposing ban on Muslim traders by Congress MLC C M Ibrahim, Minister Madhuswamy said that the government is working as per the rule of law.

The rule in this regard was made in 2002, which gave the rights to the temple authorities to award contracts to business persons who belong to Hindu religion. Mentioning the rule of 2002, the Minister said this government has no role in this regard.

"The temple authorities are telling us that they are being questioned for following the rules made by the government for denying contracts for non-Hindus. It is not possible to take action in this regard," he stated.

Meanwhile, Karnataka State Roadside Vendors Federation's President Rangaswamy submitted a memorandum to the government to see to it that street vendors are not harmed.

"Muslim roadside vendors should not be put to inconvenience. There are 2.60 lakh registered roadside vendors in the state. Among them, more than 20 per cent are Muslims," he said in the backdrop of the unofficial ban on Muslim traders in the state.

    Yes , Inside Temple compound only the Temple authorities can ban to put stall other than Hindus. If they feel then they can give also. But BOMMA told today that Temple serounding area also other than Hindus can't put stall. Why those public place any religion people can put stall by taking permission from the municipality or city Corporation. Nobody can refuse them on religions basis.

    Rudolf, Governments do not work that way. When governments change they do not always make new laws; they continue the old ones. Laws and rules do not expire. Take it from me, I have worked in the Government as an attorney for 25 years.... I began my career in the Indian government and ended in the Canadian Government 25 years ago. So I know how governments work.

    Within the temple premises probably alright. But what is not clear is the premise for such a rule made in 2002. Is this rule reciprocatory in nature that similar right of exclusion is also given to management of other places of worship. The arguments provided thus far is only enough for BJP and opposition to point fingers and not going deeper enough to understand the basis of making this rule in 2002. The first time I came to know of the issue was when Daijiworld carried an item sometime in Feb wherein SDPI installed banners to thank Ullal Darghah for allowing traders of all communities to do business during the fest.

    The rule fits the BJP government well, just like the uniform rule - in both the mischief makers were the Congress and now the Congress opposition is blaming BJP for enforcing the rules directly or indirectly The BJP doesn't need to change the rules because they suit them alright. Let Congress, when AND IF it returns to power make the changes and until then the Opposition should should be tight-lipped and keep its nose red.
