What next for Jayalalithaa ?

Bangalore, Sep 28 : An ambitious career has been put on stand by mode thanks to the verdict of the Special Court in Bangalore which held J Jayalalithaa, now the former Chief Minister of Tamil Nadu guilty of graft charges. There are many firsts in this case- she is the first sitting chief minister to be convicted and lose her seat, she is also the first chief minister to be jailed twice on graft charges.

For J Jayalalithaa the battle ahead is a long and hard one. The immediate impact of the verdict is that her membership to the Tamil Nadu assembly stands disqualified which would mean that she is no longer the chief minister. Secondly she will not be able to contest the elections for the next ten years. In the event of a conviction the rules mandate that she cannot contest an election for 6 years. Also she has been sentenced to 4 years imprisonment which adds to the 6 years making it ten.

Her next battle will be before the Karnataka High Court where she will have to seek a stay on the order of the Special Court. She will seek stay of both her conviction and also sentence. In the event of the sentence being stayed she will be able to walk out of jail where she has been lodged since last night. If her conviction is also stayed then she will be able to contest the elections and also reclaim her post of Chief Minister until the matter is disposed off finally.

























However the normal precedent in courts hearing the appeals have been that the sentences are stayed, but normally they do not interfere with the conviction. Jayalalithaa will however have to wait at least another three days to file an appeal. The High Court which is on vacation goes can hear the matter on the vacation Bench which assembles on Tuesday.
This would mean that she will have to file an appeal on Monday and seek early hearing of the matter and request the court to take it up on Tuesday. It would be at the discretion of the Chief Justice to hear the matter on the date he choses.


Following the hearing there were very emotional scenes by her followers. She is considered to be a very tall leader in Tamil Nadu and what her followers worry the most is that she would be compared to Lalu Prasad Yadav a former Chief Minister who has also been convicted in a graft case. However her followers are hoping that she is out on bail by Tuesday and can return to Chennai. Like Yadav she will continue to run the party. However in the case of Jayalalithaa she will run a proxy government as her party is in power. The run up to the 2016 elections in Tamil Nadu will however be interesting. If her conviction is set aside by then, she will be able to contest the elections. However in case the conviction stays then she would not be allowed to contest, but there is no bar from her campaigning for her party leaders.

While her arch rivals the DMK will go all out and take advantage of her conviction, she is will play the sympathy card. Unfortunately in our country this has worked a great deal where a large number of people in the lower middle class believe that such convictions are a result of political vendetta. Lalu Yadav despite a conviction in the corruption case successfully managed to come out a winner in the recent by-elections in Bihar which only goes on to show that corruption is not an issue at least in the non urban areas.

Legal experts say that the order passed by the Special Court is a water tight one. It has imposed a huge fine of Rs 100 crore on Jayalalithaa apart from the four year sentence. A lot of her followers were hoping that the sentence would be three years. The law states that if a person is convicted to a term of 3 years and below she is entitled to apply for bail before the Special Court itself. In an event of a sentence of above 3 years, the convicted person will need to approach a higher court in appeal and seek bail.

Apart from the legalities there was enough and more drama yesterday after she was taken into jail. At the end of the hearing her lawyers pleaded for leniency. Her advocates told the court that she should be allowed to stay in the hospital and also be granted Z plus security. However the court observed that these are two issues that need to be dealt with by the prison authorities. Once she was taken to jail, the prison authorities told her that she could stay in the hospital and they had already booked a ward at the Jayadeva Hospital. However surprisingly she refused any such treatment and said that she would stay in jail. Many view this as a sympathy seeking tactic.

    Many people ask when JJ is punished for graft,why not other politicians,but they should understand that these are all brought by ill fated JJ due to her arrogance and attrocious behaviours against any person including opposition parties and cunning persons like swamy.she never gave respect to any ministers,either central or state or Prime minister. She is the most egoistic persons who kicked anyone who stands against her views. Moreover the worst hooligans sasikala and her group has fully exploited her to amass huge wealth and sasikala & co. kept all the ministers and party men in terror. viewing all these things, the position of jj is very much realistic

    It is funny to see the DMK goons & anti-nationals celebrating in the media as if it is a victory for the good (vs evil).

    They forget that Swamy is right after their leaders in the 2G, Aircel-Maxis, etc. cases.

    Having said that, I have a mixed feeling on JJ's conviction. She is ego-centric, despotic, autocratic & yet patriotic. Hopefully, TN politics might clean up in 2016 elections atleast.

    If JJ can fight the case let her do it. But she has enough money to even pay 100 crores. If the judgement has to be questioned they can appeal. But i doubt such a long prolonged case can be questioned at this juncture just because it has resulted in a sentence. Why did she not fight it in the early years itself instead of dragging it for 18 years?? I am sure she has both money and influence to come out through legal loopholes in Indian legal system. In fact it won't be surprising that she may even be regarded high by gaining sympathy wave although her jail term is not like something that is served by a freedom fighter! When justice will be held high or money power overwhelms it, remains to be seen!!

    Neither any state in India nor any Politician has the dignity to criticize JJ. There are so many mediocre, useless, unqualified, unwise, selfish, foolish, greedy and cunning politicians and people in our country. The so called 'educated people' do not have brains and do not know their ignorance and stupidity. If all corrupt politicians are to be punished, then she should be the last in the list. To tell you the truth, she has the wisdom which no politician has in the country. Justice delayed is justice denied. So why now after 18years when many corrupt are enjoying the freedom. She is now a seasoned politician in the path of changing the country and her state for overall development, growth and prosperity. Some idiots from Congress and BJP are afraid her power and growth, and played a timely game to keep her away from politics as they are afraid that JJ will capture power in centre in the next election. I am particularly surprised to see the comments of some idiots who are fanatic of their language, state etc.. First of all these idiots should know their roots. All Dravidians ( Tamil, Telugu, Malayalam and Kannada ) have a common roots. Criticizing one another is like spitting on themselves. If Dravidian race is cut off from India, India is another Pakistan.

    But who is to be blamed ? Look at the mass, who do not seems to understand impact of corruption on country and poor tax-payers.
    However it is also true, the crime committed 18 years ago, now brought to justice. In this period "Jayalalita bangaya Gentle lady".
    May be after facing 11 trials she should have understood and planned the strategy to woe the people during rainy days.
    Rainy days have arrived. Watch and See, how intense the rain will be and how she will shield herself.
    Equally, the others against her own degree of "Masters in Corruption".

    This drama of getting stay and delaying the sentence till next Govt comes in and withdraws the case should stop. By the time the case comes for hearing in High Court, she would have enjoyed all fruits of her illegal wealth and may be even forgotten by all. She should be made to pay for her deeds now and not later. Let the fat be reduced. Good for her and she will live longer at least the sentence period is over.

    Based on the context, a native English speaker will understand 'tall' as as position of influence or higher standing and not 'tall in physical stature' as you have understood. In other words the writer means Jayalalitha to be a powerful politician, which she is.

    Tall contacts and English meaning is one thing. But she has fattened herself with the illegal wealth. This fat needs to be shrugged off. Jail term and penalty should be effective immediately and not after waiting for outcome from High Court and definitely not after everyone forgets her deeds. Already 1 1/2 decades have passed after the act.

    Jayalalitha has done good as well as bad in Tamil Nadu. Similar to Chaaiwaala former Chief Minister of Gujarat.
    The devil also does good and bad because the devil wanted to stay on its course otherwise people will lose faith in the devil.
    Jalyalalitha is far better than Gujju Chaaiwaala at least during her tenure she never gave free hand to commit atrocities and for mass murders.

    Why this conviction came on Saturday (weekend)to force her to go to jail till court resumes business on Monday(again there are series of holidays in oct)instructed by the GOVT?M/S Jayalalita should know her real enemy by now ? I think,certainly she will explore all possible ways to get out and Indian judiciary has loopholes in convicting corrupt political leaders as SUKH RAM of Congress, a notable politician only convicted.CHO Rama Swamy,once friend turned foe downplays her arrest and opined she will be back with a bang.

    I think judge giving sentence on media trails and public perception there was no lass exchequer or public ,there is no solid evidence against her so she can get such punishment as per my opinion she will get easy bail and can hold her sentence due validity of the case. One billion fine such nonsense fine which have no practically imposed. In Mayavathi case she said she got gift from party worker and still CBI couldn’t do anything Lalu case is different from Jaya . bail right of accused person to prove its innocence .

    No problem for Jayalalitha. she will get bail. This is 18 year old case and not valid now. Since her corruption has not claimed anybody's life, it is okay. Communal leaders are more dangerous and harmful for the society than than the corrupt leaders.

    There is no second level leaders in AIDMK that means till death Jaya Lalita will lead the party.What next is important question..Every time her rivals written off,three time CM came back to power with a bang.Under the circumstances,she is @ peak in her political career which saw a stunning downfall!!!There is no conducive situation for DMK or BJP to take advantage of the situation.But Rajani Kanth,can fill the void in the AIDMK house provided if he want join the party or even he can make it to CM post in future if he seriously thinks on that direction.Coming 30-45 days are very crucial for Jaya and AIDMK alike and until such time a proxy govt in TN could be in action.Perhaps,I guess,as court allowed LALU in fodder case to run his party's political business is a hope for JAYA and AIDMK.

    It will be a lesson to you and for all of us how our Indian Law works.
    You may see Ms. Jayalalitha out of prison on bail by this week end and even a stay on all the convictions\punishments proclaimed by the Special Court allowing her to continue her political carrier.
    One should understand, politicians get in and get out of prisons\punishment whenever they please. Indian law cannot hold them in prison for the duration court had convicted them to.
    The law works only for you and me who have no clout and not enough money to grease the palms. The ladder is tall and every rung in it has to be greased lavishly.
    Although Mr. D'Cunha passed a landmark judgement against TN CM, how long the sentenced passed by him in the Special Court will be effective?
    Better to discuss all this next week, I guess.

    Most probably Supreme Court helps "JAIL Lalita" to get bail..Nowadays it is common,last minute stay from Supreme Court..This is what we don't want..If Supreme Court brings STAY,then all these conviction,sentence,judgement have no value..no meaning..It is a green signal to all politicians to LOOT INDIA royally....
