Mangalore Crash Victims’ Kin to Hire Foreign Lawyers

Mangalore, Mar 14, DHNS: Swedish lawyer specialising in air crash cases makes an interesting offer

The relatives of the Mangalore air crash victims have resolved to hire an international law firm following the undue delay in settling cases by Mulla and Mulla, the law firm designated by Air India for the purpose.

Addressing the victims’ relatives on Sunday, President of Mangalore Air Crash Victims’ Family Association Mohammed Beary said the legal heirs/family members of the deceased passengers were unhappy with the undue delay in releasing the final compensation payment and the huge difference in the final settlement.

Quoting the victims, he described as ‘not fair’ the ‘bargaining’ tactics used by the advocates of Mulla and Mulla.

“A person’s life cannot be equated with money,” he said and added that nearly 125 of the 158 passengers who died were poor. “Just because there was no other mode of transport, they were travelling by the ill-fated flight,” he said.

The association was not criticising the advocates appointed by Air India, he said, adding that the fight was for the victims’ right.

“Though the association had decided to approach international lawyers well-versed with such cases, way back in June 2010, the idea was dropped after H D Nanavathi (head of  Mulla and Mulla) promised that he would ensure that the quantum of relief would be increased,” he said. The association was now forced to approach international lawyers as the firm had failed to keep its promises, he added.

Legal advisor for the Association  Varadaraj Kayyangal said though the victims’ relatives were supposed to get approximately Rs 76 lakh as compensation as per the Montreal Convention, the family members here should get much more as it has already been established that the air crash was due to pilot error, which amounts to negligence.

Also, the case can be filed only in Dubai or India (the flight route), as the pilot error has been established.

“If it was an aircraft error, then the case could have been registered anywhere in the world, including the US,” he said.

Varadaraj also pointed out that as per rules, Air India is supposed to settle the claims within two years. It is already 10 months since the aircraft crashed.

Lawyer’s promise

Soon after the meeting, the families met Stephen Ericson, an advocate from Stockholm, Sweden, who is well-versed in handling air crash cases.

He was in Mangalore on the request of the association.

He assured the families that he would not charge fees for compensation amount less than Rs 57 lakh (in case of infants) and Rs 67 lakh (in case of women).

“It means the families would get a higher compensation amount as against the amount offered by Mulla and Mulla, which is less than Rs 30 lakh in several cases,” association Treasurer Abdul Razzaq said.

Beary said the association and the advocates’ firm would hold discussions with a London-based insurance firm.

“If needed, we will file a case in Dubai court,” he said.

Survivors too left in the lurch

Two survivors Pradeep and Joel too had come for the meeting. They said though they were assured of jobs by the Air India CMD soon after the crash, they have not heard from Air India till date. Ashraf, speaking for his brother Umer Farooq (another survivor), said his brother feels that it would have been better if he had died in the air crash.
“Living after the crash, without a job is hell,” he said.

    Dear commentors as per my knowledge & being a family member of victim i'm happy with what air india offer.   I feel they do right calculation as per law which is done in front of me. Regarding job they offered contract basis job  I'll be more happy if they offer permanent job.   You need money right that can be made by any means but what about the person whom v lost will they come back?  

    I know the pain behind that & so many claims for a single person money why? In front of money there is no relationship. Abt court matter how many years it will take to sattle the matter till then who will pay for victims family member daily need is the association will pay ? instead whatever u get deposit in bank with that interest u can live your life.

    Mr Moily should retire now. ISRO and NSRA have conducted the study at a cost of over 15 crores and found out that river diversion plan is nothing but madness. The report is there with the State government. I ask one question to Mr Moily, one dam or bund burst after the diversion what would happen to the coast with the consequent landslide from the Western Ghats? Get back to your village and join the old profession of paddy and toddy cultivation Veerappanna!

    I lost one of my family member in air crash,My family people now looking for the Money as main issue, they dont care for our sentiments, its money and more money, hell with the money, when i lost my brother,Life is more than money, I hope people know this, and today i know most of the people want big settlement form Crash, and no more remembering our lost dear ones !Its a mad world people are Greedy, God save us all. from this Greed, I wish we get nothing from this air crash settlement , Because then issue will be who will be dividing the claim and how much each of us get ? ( even this is the usual talk in my house)

    Those who died in in the floods two years ago in North Karnataka didnt receive any compensation. Those who survived are still homeless. If someone dies in a road or train accident they get a few thousansd or lakh Rupees. Those who died in natural calamities rarely get any help/compensation from the government. And here they get 30-60 lakhs as compensation and they say that is not enough. Hope the victims will forgive us.

    I believe its about the rights of the victims, who have perished in the crash. They should get their full dues as per the policies. Who benefits and what the beneficiaries do with the compensation is secondary. The airlines, its representatives, and associated insurance companies have to bear this cost, as airlines have a pre-requisite for insuring themselves against such unforeseen incidents. Guess in India its always a 2 way street..

    Dear friends, my heart felt condolenses on sad demise of your near and dear ones. It is un believable to learn that Air India has still not settled the death compensation lawfully. When the crash took place in May last year, the whole country appreciated the government and Air India as they announced immediately the compensation in millions, Indian politicians were very busy visiting victims family and the compensation.

    This is truly unbelievable that the victims’ death money is still in pockets of Air India. This is a big concern to the people who will travel by this Government owned Airline in the future also. God forbid such crash should not happen in the future, but if happens, what will be the fate of people who depend on this corrupt Airline Company. If it was a private international Airline, definitely, the compensation would have been settled by now to all the families. This just because of corrupt Government, corrupt officials in Air India. Only God has to save the people who ever is flying by this Airline.

    This is the worst airline currently running into huge losses so much that it does not have money to pay its employees, salary is running behind schedule for upto 1 month! Daily expenditure is 50cr plus and income is less than 35cr. This is because of the chronic inefficiency of the employees...

    Why are they hesitating to give full compensation to the victims next of kin?

    No one should settle for less and fight this out as there is a very high possibility of them getting full compensation.....
