Never seen my grandmother, mother, sister wear headscarf, Muslim man tells SC in hijab row


New Delhi, Sep 6 (IANS): A plea has been moved in the Supreme Court claiming the non-essentiality of hijab for women in Islam, and seeks to indicate the correctness of the Karnataka High Court judgment, which upheld the right of educational institutions to ban the head covering in pre-university colleges in the state.

The intervention plea has been filed by Syed Habeeb-ur-Rehman, a former officer of the Indian Armed Forces and then serving ITC for 37 years and also being appointed to its Board of Directors.

Rehman, represented by advocate Jai Anant Dehadrai, said he has always condemned "gross and perverse misinterpretations" of the holy book and it is in this context he wishes to put forth his years of experience, knowledge, and practical and wider understanding of Islam and essential Islamic practices mandated in the Quran vis-a-vis the Constitution.

Seeking to intervene in the matter, he said: "The applicant is a secular and progressive Muslim observing the spirt of Islam, who seeks to bring to the attention of this court that in his 80 years, he has never seen his own grandmothers, grand-aunts, mother or sisters, who all observed the spirt of Islam, wear even a headscarf around their head."

Rehman said he seeks to assist the apex court with the correct theological interpretation of the holy book to dispel the false notion that it contains a mandatory direction of wearing of hijab.

"Rather, the idea that Muslim women are compelled to wear a hijab is the outcome of ignorant and radicalised entities, who are wrongly furthering an extremely backward and regressive misinterpretation of the holy book by claiming wearing of hijab by women to be an essential religious practice," his plea said.

The plea contended that even from a Koranic perspective, it is abundantly clear that women were not directed to wear hijab, rather the direction was for the believers of the faith to maintain distance from the wives of the Prophet while engaging with them.

It added that since the Koranic text clarifies that wearing of the headscarf or hijab is not a mandatory or essential part of the Islamic religion, therefore, the appelants cannot claim a direction in the nature of creating collective belonging for students, on the specious claim that it offends Muslim student's right to religion.

"The Government Order dated February 5, 2022, does not prohibit Muslim students to wear hijab in public or private spaces, it only restricts the usage of it inside the institutional premises, where the students have gathered for collective and secular pursuit of education," said the plea.

The top court is scheduled to continue hearing a clutch of petitions against the Karnataka High Court judgment, which upheld the right of educational institutions to ban wearing of hijab in pre-university colleges in the state, on Wednesday.

Religions destroyed whole Middle East now comes to India to destroy . Muslims Hindus Christians all lived a peaceful life in the past but due to some idiots of religious intolerance everywhere people fight for identity issue just because of losers go everywhere and create uneasy lifestyle to destroy peace. This the reality we see west today goes very difficult times to distribute tax payers money for refugees and child support for dozen of kids per family who pour from all self created war torn countries just to create chaos same like this issue what you are saying.     Quran says men and women to dress modestly to cover their private parts. Specially women to cover their hair and chests. Increasingly important visibility of Muslim women in the west causing some serious confusion. Another problem is our so called scholars interpret Quran according to their individual opinions. Some of them want publicity and some of them wanted to be counted as an expert or scholars in religion. Nowhere in the Quran has the term Hijab which mean a scarf that covers Muslim women’s hair. The semantic and conceptual interpretation of the Quranic term Hijab shows the opposite of what is supposed to be in reality. I have seen Muslim women in America wearing Hijab with T-shirt and jeans pushing baby stroller. I am sure everyone saw similar or even worse. yet I am all for Hijab don’t get me wrong but firstly know the meaning of it and specially what Quran said. Simply put Hijab is a piece of clothing over the head and end of both sides should come down to cover their chests . Learn and know the true meaning of covering the body parts that are private. Lately in some parts of the world Muslim women are wearing scarf matching their saree or other clothing. Some of the Muslim wearing Jewelry over the Hijab made of multi colorful materials. That is actually going against that reason they supposed to wear Hijab for. That is inviting not covering . Instead of that just wearing some form of clothing that cover your body and not showing any skin. That is respectful . Bottom line is just don’t follow another person without knowing the fact. Learn yourself and you will do it from your heart. Only wearing Hijab no use but living as per God' s wish is better.

    Only clergies who spend decades to become Alim has rights to talk on interpretation of Quran. All these idiots who claim to be talking interpretation don't even read Quran daily, may not even be punctual in their regular 5 times mandatory prayers. If his grandmother, mother doesn't wear hijab means the Islam doesn't change. If his grandmother, father, mother doesn't offer prayer or give zakath or observe fasting means should other Muslima have to follow the same? All these lallus have no right to talk on Quran interpretation irrespective of being a Muslim. If I have studied medicine by enrolling into MBBS course, then I have no right to prescribe medicines to others even if I have read medicine books. I am not a doctor yet. Sirf Habibur Rahman, ya Abdullah naam rakhne se koi Musalmaan nahi banta. They have to follow what has been prescribed in Quran and Hadith without doing any Chu charah.

Will the SC also stop construction of Rama Temple in Ayodhya if a hindu goes on record and says that he has never seen his parents go to worship in a Temple?     If somebody’s personal practice is taken as template to deliver a judgment then judiciary needs to shut down . Many Hindus eat beef , many Muslims drink .but that shouldn’t mean we ll tell majority of Hindus to start eating beef because a minuscule of population eats it or telling Muslims , drinking is permissible because some among u drink . If one family Serves as template for whole majority then that family should be considered God’s own family .
