Delhi HC orders Arvind Kejriwal's release from Tihar jail



New Delhi, May 27 (PTI): The Delhi high court on Tuesday ordered Aam Aadmi Party leader Arvind Kejriwal's release from Tihar jail. The court accepted the bail bond of Arvind Kejriwal filed by his advocate in a criminal defamation complaint.

Earlier on Tuesday, Kejriwal agreed to furnish personal bond to get bail in the criminal defamation complaint filed against him by BJP leader Nitin Gadkari.

The former Delhi chief minister, who has been lodged in Tihar jail, accepted to do so on the suggestion of Delhi high court earlier in the day.

Kejriwal's lawyer told HC that personal bond of Rs 10,000 has already been signed and will be filed before magistrate today itself.

A bench of justices Kailash Gambhir and Sunita Gupta had said that Kejriwal can raise whatever legal issues he wants to, once he comes out of jail and that he should not make it a prestige issue.

Senior advocate Shanti Bhushan and advocate Prashant Bhushan, appearing for Kejriwal, had sought to meet the Aam Aadmi Party (AAP) leader in prison to seek his instruction and put forth the court's suggestion.

The judges advised Kejriwal to furnish the bail bond and said that the same would be subject to final outcome of the legal issues raised by him. The legal issue raised by Kejriwal, in his petition seeking his immediate release from the jail, is whether bail bond is necessary in summons case when accused appears and is accompanied by a lawyer.

The petition challenged the May 21 and 23 orders of a magisterial court remanding Kejriwal in judicial custody for not furnishing bail bond in the criminal defamation complaint filed by Gadkari, saying the same was not mandatory and he should have been allowed to give a written undertaking instead. Kejriwal in his plea, filed through advocate Rohit Kumar Singh, has said the magisterial order sending him to judicial custody was "illegal" as it was based on a "completely wrong premise of law."

During the proceedings, the bench suggested that Kejriwal should furnish bail bond and challenge the magisterial orders once he comes out of jail. It also questioned how a habeas corpus, filed on behalf of Kejriwal, applies against a judicial order. A writ of habeas corpus is used to bring a prisoner or detainee before the court to determine if the person's imprisonment or detention is lawful. Kejriwal's counsel argued that his detention is "totally illegal" as only a person in custody is required to furnish bail bond.

    If Modi is all about integrity and no corruption the why

    1. Has he appointed Mr Gadhkari to his cabinet. Mr Gadhkari is on record being corrupt and was demitted from the BJP president-ship before elections

    2. Why does Modi not propose to implement a Lok Pal bill. Everything else seems to be on his agenda, except a Lokpal bill. BJP has a absolute majority. During the anti corruption movement, BJP pretended as though they where for the Lop Pal.

    Guess what, Modi will never pass the Lok Pal, that is how much he cares about corruption. Without a Lokpal, there is no one you can complain to about corruption. You accuse a powerful politician of corruption then the courts will make it a bailable offense.

    Exactly. The judge explained this very clearly to Kejriwal. Kejriwal continued his attitude of "myway or highway". Judge sent him to the jail.
    The bottom line is that Kejriwal expected more limelight in preparation for Delhi assembly elections. But media started focussing on Modi's swearing in. Kejriwal thought that it is waste of time spending time in Tihar, and opted to furnish the bond.
    Now don't remind me the proverb - kelage biddaroo moogu mele"
    Let Kejriwal take sanyas from politics and join Anna. Then he will have some credibility to fight against corruption.

    Thanks Mr. Jafer, Ullal, You seem to be a lawyer or Law student. But I did not get your point. You say personal bond ( no money paid) but above you say “the judge will revoke the personal bond, take you into custody and you must forfeit the amount of the personal bond to the court”

    If he has not paid money with personal bond, then from where will the court forfeit the money ? Kindly explain. Thanx

    Let Modi Govt do good work, but let there be someone like Arivind Kejriwal to keep a tab on them.
    People do not expect Congress to be a good opposition because they have reached to a saturating point, at least for now!
    Congress themselves have lot of weakness, they need shield, how they will be a good opposition?

    Did you read and understand what was written in the article.

    He has been released without bail by the High Court. He has furnished a personal bond to the court that he would be present for all their hearings.

    That has been his contention all along that he is willing to give an undertaking to the court that he will be present for all their hearings but he would not pay bail as he is not a criminal.

    The Delhi high court has upheld that.

    Please do understand the matter before commenting.

    Going by your rant, it appears you are high on Modi to know the difference between a personal bond and a bail bond.

    AK stand has always been that he is willing to give a personal bond, but not bail.

If you fail to appear when required to by the court's schedule, the judge will revoke the personal bond, take you into custody and you must forfeit the amount of the personal bond to the court

    Hope readers will distinguish between Personal bond(No Money paid) and Bail money(Money deposited before court to get bail)before commenting against Kejriwalji

    Only of good sense had prevailed on Kejriwal to sign this same Bond one week bank, we wouldn't had to see this day. He would have tleast witnessed Modi's swearing in in person. All for sympathy votes ?? and what did he get at the end of it ? That he is Nautanki Raja of India ???
