New policy for domestic workers proposes Rs 9,000 per month, paid leaves


New Delhi, Aug 17 (PTI): To protect the interest of domestic workers, the government is readying a national policy that proposes a minimum salary of Rs 9,000 per month for the skilled full-time household helps, along with a host of benefits including social security cover and mandatory leaves.

The draft 'National Policy for Domestic Workers', which would be soon moved for approval of the Union Cabinet, also calls for provisions against sexual harassment and bonded labour and recommends compulsory paid leave of 15 days a year as also the maternity leave.

Besides, the Policy provides that the domestic workers be given a right to pursue education, a safe working environment and a grievance redressal mechanism. It also has a provision for mandatory contribution from the employer towards social security of the domestic workers.

Workers and employers will also have rights to form groups and engage with each other for 'collective bargaining'.

A draft note in this regard, prepared by the Director General Labour Welfare (DGLW), was submitted to Labour Minister Bandaru Dattatreya last week.

"The Domestic Workers Policy has to be framed. Domestic workers are also subjected to exploitation and therefore the welfare and protection of domestic labour force is very important," Dattatreya told PTI.

"The policy framework is on par with the standards of the International Labour Organisation. India has adopted the ILO convention on domestic workers and therefore we have to make a policy for this segment of the society," he said.

Once it comes into force, the policy will make it binding to enter into a tripartite agreement between the employer, the worker and the intermediary agency that connects the two, a senior Labour Minister official said.

The draft policy recommends minimum monthly wage for unskilled, semi-skilled, skilled and highly-skilled categories of the domestic workers.

"Highly-skilled and those giving full-time service should be eligible to get a salary of at least Rs 9,000 per month," the official said, while adding that the aim of the policy is to empower the domestic workers by making this large workforce a services industry in due course of time.

"The policy for domestic workers was underway since 2007.

It went to the Cabinet twice -- first in 2013 and then in 2014. But, it was later on referred to the Group of Ministers as Right to Collective Bargaining and Freedom of Association, which are integral parts of ILO convention, were missing in the draft proposed at that time," the official said.

Now both these points -- Right to Collective Bargaining and Freedom of Association -- have been included in the revised draft policy, the official added.

As per ILO, the right of workers and employers to form and join organisations (worker unions or employer groups) of their own choosing is an integral part of a free and open society.

On Right to Collective Bargaining, the ILO says the right of workers to bargain freely with employers is an essential element and workers can approach employers directly or through their representatives for the 'collective bargaining'.

Dattatreya said that the policy for domestic workers is pending since 2007 as the UPA government did not pursue it.

"Social security is one the biggest focus areas but the UPA government completely neglected it," the Minister said while adding that the revised policy framework is now in line with the ILO recommendations.

"We have taken it one a priority basis. Now this policy is going to the Cabinet and therefore the necessary legislation will be made," Dattatreya said.

    Its good initiative provided penalty clauses are mentioned . Commercial workers too need such protection as their salary amounts to peanuts . With mushrooming of colleges , huge percentages of graduates or post graduates working for shocking low salaries across cities . Eg:: a mcom or mba post graduates working for 3000 per month , in some cases its even worse . Government has to intercede here and implement Minimum wages act as in developed countries .

    Its good that government is fixing salary for maids working at home. Can we also ask the government to think about office staff getting salary of 4000 to 5000. Those who have done their M.Com also don't get this salary. First let the government make a salary package for the ones working in office. House maids have so many demands and they come and go as per their time but people who work in office have to work for 10 hours and still dont get 9000k. If we have to pay the maids 9000 then our salaries should be atleast 20000. I hope the government considers this. Make a system that the company pays the salary directly to the bank account and there is monitoring done on how much salary and date of payment of salary to the workers. government should stop giving facilities to only one class or category. Instead think about the complete system and upliftment of all the citizens. In future i feel highly educated will be working as maids seeing the salary they get.

    Hair dresser in manganlorel earns 50000 per month who comes from Delhi to work in Mangalore, I was shocked to hear this in my last visit to managalore from one of the boy who works in a saloon near State Bank.

    @S prasad,Kateel,you are shocked to hear the amount?look,when a marriage at home is ,a hair dresser asks least 20,000Rs.and in a month you can imagine how many marriages are conducted and they earn.The Problem at present is you get a hardly domestic worker since all of them have gone to Uae or dreaming of it.One way is better their salary is increasing,because previously they were paid less and day and night harassed and had to tolerate all types of Problems including rape ,physical torture,with hot iron,etc.food was different to them.

    Good for the skilled domestic helpers but how many households are ready to honor such benefits.
    This equivalent to the benefits maids are paid in some GCC countries. But under harsh working hours and sometimes torture in the hands of the Employer.
    I do not think that some employers pay that much salary to the staff (fresh graduate) in the office.
    During 60's the starting salary in the Banks used to be around Rs.500.- per month.

    We live in a country where dogs are more safer than humans. there is a law for poor people(BPL). Thats good, and Above middle class they too have no issue only the middle class family will have to bear all these.

    Let them first implement minimum salary for each category.Why for only one group ? Is it mean who keep domestic maids are millionaires ?

    See this rule is for full time very workers. Which is not a common practice with middle class families. What Middle class families have is part time workers so I don't see them getting affected.
    About full time employment at alt east in metros I don't see anyone taking less than 9000 for full time work.
    Also about 15 day paid leave wont be an issue because generally we give them that leave.
    Only pinch / change this rule will bring in is maternity leave benefit to this sector. I hope they will put some condition on employment tenure for giving this benefit. Also private sector should think about increasing the maternity benefit to match recent government notification (6 months). If we get similar benefits we should also pass it on... its win win for all.

    Law is applicable to FULL TIME HOUSEHOLD.....Once Law is passed Mam Saab will hire tow workers....Morning to Afternoon and Second one Afternoon to Evening.....So law is NOT applicable here....

    Success of any law, depends upon its fairness,righteousness and economic viability.
    Employing domestic servants may become possible only to the rich. Old and retired will be hit hard.
    Some Govt Officials will try to make money out of new laws.
    Some domestic workers may loose jobs, for many employers will not afford food plus Rs.300/- per day wages.
    They will end up doing their house chorus by themselves.
    Unemployment also may increase.

    Good law favouring the domestic workers. What are the working hours as per this law? what happens when they take leaves without informing? All the rules in this law should be laid down clearly because domestic help have their own whims and fancies and take huge loans from their employers and many a times leave the job without either informing or repaying!

    Because of the advent of shopping malls in the city, most of the young and middle aged females prefer to work in the air-conditioned ambiance.

    Hope the new legislation would bring some relief to the employers.
