Bengaluru: No case against clients in prostitution raid, says high court order

Bengaluru, Sep 19: In an important order, the high court has ordered not to book any case on the customers during a raid on prostitution dens.

The single judge bench headed by justice K N Paneendra said that there is no room in the law to register a case against a client who visits a prostitute.

The police force had raided a prostitution den in a hotel in the city and arrested the clients and registered an FIR on them under section 3, 4, 5, 6 and 7 of The Immoral Traffic (Prevention) Act of 1956 and IPC section 370. The court which conducted the inquiry of this case said that there is no provision in the law to register any case against the customers who visit the prostitutes.

In addition, the court has ordered to cancel the case registered against the customers. It also said that IPC section 370 (accusation of physical and sexual exploitation) will be applied to the applicants of the case. Applicants are only the clients of the prostitution. There is no accusation on them in the FIR under any sections of the IPC and these sections are not applicable to the clients.

The court has asked to cancel the case against the applicants.

    Time & again, the failure of the legislators have been exposed. The citizens have no recourse but to approach the court.

    And the court should rule in favour of legalizing prostitution just as they have done in the case of LGBT.

    These women have every right to earn a living legally and not depend on some judgement passed by a nincompoop brain dead nit-wit of a self styled god-man.

    Now clients would be encouraged without the fear of being subjected to any action against them. Business too may flourish in the days to come. Some hoteliers also will be happy with the court decision.

    Woman has a right to earn with prostitution...
    It is not a crime a all if both parties are willing....
    Regulate and control... But make it legal...
    We may see less tragedies like Haryana Topper and Nirbhaya.....

    This judgement is very progressive. Hats off to Honourable justice Mr.Paneendra. I know a lot of men are not happy at home.Nowadays many boys are not married even though they attained age of 60 years. In this aspect Govt.of Maharastra has gone a step further in allotting separate land & building with current & water to run brothels.

    This is a anscient profession. During Shri Krishnadevaraya maharaja of Vijayanagara empire there was separate wing of prostitutes, entertainers with his military that I have read in one of novels written by Mr.Koratagere Shrinivasa Rao. It was a story of Bhakta Kanakadasa.
