Nirav Modi's properties worth Rs 1,400 crore can be confiscated: Court


Mumbai, Jun 8 (IANS): In a significant order, a special court in Mumbai on Monday ordered the Enforcement Directorate (ED) to confiscate specified properties, worth Rs 1,400 crore, of fugitive diamantaire Nirav Modi within a month, a lawyer said.

"The accused (Nirav Modi) was declared a fugitive economic offender on December 5, 2019, and the order to confiscate the properties has come on Monday," Special Public Prosecutor Hiten Venegaonkar told IANS.

The order by PMLA Court Special Judge V. C. Barde directs the agencies concerned including the Income Tax Department to attach and confiscate the listed properties, under Sections 12(2) and (8) of the Fugitive Economic Offenders Act, 2018.

However, the properties claimed by certain interested parties which are secured by way of hypothecation, mortgage etc, including valuable paintings seized by the Income Tax Department, are excluded, Special Judge Barde ruled as he partially disposed of the ED plea.

These interested parties, including banks, will be required to proceed with their claims on such mortgaged, hypothecated, guaranteed properties before a competent court, authority or tribunal, as provided in the law.

The ED has been granted liberty to file a supplementary application in case more properties of Modi are identified for confiscation.

Modi, along with his uncle Mehul Choksi, is among the prime accused in the Punjab National Bank (PNB) fraud of over Rs 14,000 crore, unearthed over two years ago.

Currently, Modi is in a London prison after his arrest by the local police in March 2019, while Choksi has become a citizen of the Caribbean island nation of Antigua & Barbuda.

    Court is treating Nirav Modi as son in law of bjp and very soft on him. Same court orders for seizing of property of poor poeple who takes a loan of few hundred rupees and fails to return on time. Nirav Modi is a day decoit having looted crores of rupees under the support of politicians and now the court says that his property can be seized. What a joke. Is court joking. Is there different rule for poor citizen and day looters. There is either something black in daal or whole daal is black. I am sure that court is trying to be soft on Nirav Modi and dont want to take any action on him. Modi is enjoying five star life style in foreign country utilizing hard earned money of indians. and no action is yet taken against him. Court will sentence a minor poor boy stealing bread but closes its eyes on looting of thousands of crores of rupees by white collar decoits.

    Modi, along with his uncle Mehul Choksi, the prime accused of fraud over Rs 14,000 crore. After 2 years the court says his properties worth Rs. 1,400 -CAB BE- confiscated.
    The court had to wait for 2 years to tell - you -CAN- confiscate of the properties of the accused worth just 10% of the fraud amount. Joke of Indian Judiciary system.

    Wow, govt became Rs 1400 crores richer. There are even few more where govt can tap out few more bucks. This was the main reason all these fugitives were ceremoniously escorted out of the country. Now they are in a fix can not even legally claim that money.
