Homosexuality not a crime, says CJI Dipak Misra as SC ends Section 377


New Delji, Sep 6 (Agencies): Homosexuality is not a crime. LGBT community has the same rights like other members of society. Sustenance of identity is the pyramid of life, observed CJI Dipak Misra here on Seotember 6 delivering verdict of Section 377.

"No one can escape from their individualism. Society is now better for individualism. In the present case, our deliberations will be on various spectrums," ruled Supreme Court.

The issue of section 377 was first raised by an NGO, Naaz Foundation, which had in 2001 approached the Delhi High Court that had decriminalised sex between consenting adults of the same gender by holding the penal provision "illegal".

Although the Delhi High Court had struck down the provision in 2009, it was revived by the Supreme Court in 2013 in a widely criticised judgment by a Division Bench of Justice G S Singhvi and Justice S J Mukhopadhyaya. However, the issue resurrected in July 2016, when a fresh petition filed.

The five-judge bench on July 10 had made it clear that it was not going into the curative petitions and would adjudicate on fresh writ petitions in the matter.

"Social stigma will go if criminality of gay sex under Section 377 goes. Once the criminality (under section 377) goes, then everything will go (all the bars, social stigma and others)," said the bench headed by CJI Deepak Misra, which also comprised Justices R F Nariman, A M Khanwilkar, D Y Chandrachud and Indu Malhotra.

Observing that an environment has been created in the Indian society over the years that has led to deep-rooted discrimination against the community, the bench had said discrimination against such people has also adversely impacted their mental health.

The writ petitions were opposed by the Apostolic Alliance of Churches, Utkal Christian Association and some other NGOs and individuals including Suresh Kumar Kaushal who had also challenged the 2009 verdict of the high court in the apex court.

LGBTQ (lesbian, gay, bisexual, transgender and queer) community faced the stigma because of the criminality attached to consensual same-sex relationship, the bench had said.

The Central government had left it to the apex court to test the constitutional validity of section 377 of the IPC which criminalises "consensual acts of adults in private", urging that issues like gay marriages, adoption and ancillary civil rights of LGBTQ should not be dealt by it.

Taking note of the Centre's submission that other issues like gay marriages, adoption and ancillary civil rights of LGBTQ community should not be dealt, the court said it was not considering all these issues.

    Some commentators don't understand the pain of those gay community. They are not doing it purposely. They are born that way..if this counted as sin, even the parents committed sin by giving birth to them?.. Those who studied their grievances or their pain and those who such members in their family they won't speak such things like sin, curse, giving bible references etc etc.

    What ever it is This is wrong and it is surely a sin before God. I have 2 Boys and a girl who is just 10 years. My Sons asked me about this and I had to explain as a human being. My elder son is 14 and other is 12 years. I really want to see my Kids grow and not to be gays. My Children are well informed and they do not hate such people ,but will never support them. Looks like human race is finished and has become Violent in nature. Even Animals do not have gay sex./Learn from them.     Swans, penguins, sheeps, dolphins, elephants, giraffes and many more- these animals have shown homosexual behavior. There's even a wikipedia page on homosexuality among animals!

    Also, search on google for homophobes and self-reflection. There's a psychology study on homophobes. It says that people who hate/are scared of homosexuals maybe a little gay themselves, but are afraid of societal expectations. So think about yourself, maybe you have some homosexuality in you too. And guess what, it's okay. It's normal to be gay/bisexual. Nothing will change, there will still be people who love you for what you are!

    Homosexual people are like us... This is not sin. Homosexuals are not born in western countries but they are everywhere in the world...western countries were more open to ask their rights and appear in public but in India,
    fear of society deprived them to do so. the word itself mentions "homosexuality" people attract towards their own gender in other words how boy attracts toward a girl and girl towards a boy. There is one more third division among us are "transgenders".

    They are born that way it's neither parents fault nor their fault... It's purely "god's creation". Such behaviour we can see in animals too... Some one is saying its a curse on society. Sodom and Gomorraha got destroyed because of this... Why we didn't have such law till today.. In India we didn't experience natural disasters? Flood, earth quake, courageous diseases like small pox, plague didn't come?

    According to the studies by psYchogists, homosexuality is not a curse. Those who have passed this law are not illiterate.. Considering the facts and thereby studying the same, it has issued proper verdict. If some of us condemning decision of the judges, let's sit on the bench of judges.

    Let's accept homosexuals like how we are! Let's not pass cheap comments, let's not mock at them.. Every one has right to "LIVE".

    If every couple is boy and girl today, our world would not have been sufficient to carry the load of our population.

    Do you really know what this judgement really is about? Why are you bringing in small girls here? Do you know the meaning of gay or LGBT? Why are you equating gay people with child rapists and molesters? Gay people do not go after small girls. A gay man is only attracted towards other men and he does not go about molesting small girls. A lesbian is attracted towards other women.

    The Supreme court has not legalized molestation, child abuse or rape. It has only legalized relationships between gay people and given them their rights and dignity which was deprived until now. The eminent judges have also said that the society owes them an apology for they way they had been looked upon all these years and the humiliation and agony that they had been made to suffer in an unjust society.

    After reading many of the comments, I feel sad that in spite of all the education and advancement, we Indians are still backward in our thinking and outlook. It is my way or the highway. Each one thinks that he alone is right and the only truth is the one that he believes in. One is not ready even to glance at the other side and understand what it is. I have decided that Gay is bad and so the whole world should think as I do. I hate a community so everyone should also hate that community. I am vegetarian so the whole world also should be vegetarian. I believe in X God and there the whole world also should believe in X God. What I think is a sin is universal sin.This is our pathetic level of thinking.

    You keep bringing GOD. Has God told you to victimize others.

    It is a cruel society which has deemed homosexuality sin and not God. Don't drag God into this. Maybe the day you discover that someone close to you is a homosexual, you will change your view as I did.

    I had indifferent views on Homo sexuality and thought it was some kind of a disease and a deficiency, which could be cured until I came across a close friend who revealed to me that he was gay. I had then suggested treatment and counselling to him, which he did undergo. I saw the poor guy suffering and going through hell. He too believed for a while that he was sick and was even on the verge of committing suicide. Finally he accepted what he was but had to move out of India and is today living with his partner in a western country. He is doing well and is contended. I am sure he will be a very happy man today. It was during this time that I started doing my research and study on homo sexuality and my eyes opened. I hope people who deride them too will spend some time in studying this subject.

    A great judgement by the Supreme Court. Sense has prevailed in the end. Liberal society had no place for such ancient laws. I do not know why the world looks at homo sexuals and gays as criminals. They are born as such and their preferences are determined in their genes. Would you kill a child with special needs or a child born physically challenged? Why then victimize these people? In what way are they harming society? They are perfectly normal people who only have a different sexual preference. Does the present Prime Minister of Ireland look like a criminal? Does the world renowned TV journalist Richard Quest resemble a criminal? There are hundreds and thousands of gays across the world who have reached great heights in society as leaders, artists, musicians, scientists, authors, scholars etc. All these years in our country they have been only crying for justice, equality and understanding and why cant the society give it to them? Who are we to brand them sinners and criminals? Just let them be and let them lead their lives in peace.

    Don't blame God for mans stupidity and ignorance.
    May be you should dwell on why so many of our national leaders are single, and artists and poets.
    If Gay people had their rights from the beginning, then they would have had a normal relationship with a person of their own gender and not be promiscuous in secrecy. They would have had families and raised children, either their own or adopted, with good values.
