Mangalore, Feb 10: City-based senior advocate, Purushottam Poojary, has branded as utter lie the recent media reports which said that a division bench of the state High Court had, on February 2, dismissed a single judge bench order entrusting the case relating to the murder of young lawyer, Naushad Kashimji, to Central Bureau of Investigation (CBI), as false.

“The division bench has not struck down the single judge bench order. It has sought reasons to support the demand for entrusting the case to CBI to be filed with it before February 23. The media reports have given wrong information to the people even before getting copies of the order,” he said.

Relating to the slaying of Kashmiji in 2009 at Sturrock Road in the city by miscreants by using pistol, the policemen had arrested 12 persons. But,  Purushottam Poojary had accused DySP Jayant Shetty, inspectors, Venkatesh Prasanna and Valentine D’Souza, and sub-inspector, Shivaprakash, of having a hand in the advocate’s death, in a private complaint lodged in the JMFC court here.

In the meanwhile, Nusrat Jehan, wife of Kashimji, had filed a writ petition in the state High Court, seeking orders for CBI investigation in the case. The government had preferred an appeal against the order of a single judge bench presided over by Justice Mohana Shantana Gowdar for entrusting the case to CBI. The division bench with judges, Justice V J Sen and Justice Nagaratna, has now sought clear reasons for entrusting the case to CBI, Poojary stated.
