Mangaluru: CWC finds adoption illegal, but girl refuses to accompany biological parents

Mangaluru, Jul 16: Child Welfare Committee (CWC) of the district has come to the conclusion that the way a girl from Kakkinje Chibidre in Beltangady taluk was adopted by a couple was not proper. The committee came to this decision after considering a complaint filed by the biological parents of the girl. However, the girl was entrusted to Prajna Counselling Centre on Wednesday July 15, as she refused to accompany her biological parents.

The girl in question had been adopted by a Catholic couple some years back. The parents of the 11-year-old girl had approached CWC with a complaint stating that the girl had not been legally adopted. Hence, they had sought custody of the girl. CWC, which held hearing, noted that Christians are allowed to adopt children under Juvenile Justice Act alone and not under Hindu Adoption and Maintenance Act. It concluded that the adoption process which took place on October 29, 2014, was illegal.

It is said that when the biological parents of the girl and adoptive parents were questioned on December 17, 2014 by CWC, the girl had expressed desire to stay with adoptive parents and get educated. The biological parents had agreed to her desire. Both the parents were asked to be present before CWC again on January 28, 2015. Even on that day, biological parents of the girl had agreed to allow the girl to be with her adoptive parents. CWC had ordered for making room for the biological parents to meet their daughter now and then.

In between, the biological parents of the girl approached CWC with a complaint that the adoptive parents of their daughter were not allowing them to meet the girl. The committee ordered the girl to be presented before it. Accordingly, the girl, her biological parents, and elder brother, were present on Wednesday. On this occasion, the girl, with tears in her eyes, refused to go with her biological parents, and expressed her willingness to stay with the couple who adopted her. Therefore, she has been ordered to be entrusted to the care of Prajna Counselling Centre until further orders.

President of the committee, K Nikhesh Shetty, said that opportunity has been provided for her biological parents and other children to talk to the girl, so that an environment that is congenial for her to join her biological parents is created.

    Now the Girl is grown up,is no more child,have no tough Task of looking after,may be they want some Money .or disturbing her everynow and then to ask Money ?They should be happy atleast are allowed to meet her.why come now to complain that Adoption was not legal?they must be having some plan?Who are they?where were they till now ?Let the child be there as happy now.let her study and lern something if possible.

    Shame on the CWC which forces the child to go to the biological parents... I have had another experience where the CWC did a similar thing in 2010 forcing a 14 year old to return to the biological parents... because there was no 'legal' adoption, despite the fact that there was concrete evidence of torture. The boy chose to live with the adoptive parent since he was cared for by them since the age of 6 months! SORRY TO SAY THAT CWC WAS ACTING NOT IN THE INTEREST OF THE CHILD. I HAD SERIOUS FEARS THAT CWC HAD RECEIVED A BRIBE FROM THE BIO PARENTS!!!

    In western countries, if the biological parents violate children's right, they are given to foster parents whom they entrust after proper evaluation with frequent visits.
    Here C W C should look into the economical condition of the biological parents which prompted them to give their kid to adoption in the first place. Instead of facilitating girls return to her previous state, they must help her to become legal daughter of her present adopted parents whom she loves rather than forcing their will on her & ruining her future, if that is what Prime Motive or Intention of C W C.

    looks like the bio parents now want to 'use' the girl after she brought upto 11 yrs by the adopted parents. Shame on outdated action by CWC and also the bio parents - were they sleeping all these yrs?

    As She got true love,care from the parents from adopted, she believes they are her own parents and she is happy in her life. As she don't know the truth, after she grow why biological parents went to put poison and destroy her peace, happiness, life, feature.may it will lead her to depression and may something happen than they will be the responsible for that. It is destroying peace of the adopted parents too.

    Its best for girl to remain with this adopted family.Where she found love and care.I fear this situation may lead for suicide or something if its not handled properly.who are these CWC people to heart the tender heart of this child? Lets people and organisations in Mangalore join hands and fight for the life of this Child,before its too late.

    Has the CWC thought about what is in the best interests of the child? They are forcibly asking her to accept parents who she does not know, and alienating her from her true parents. I would file a case against the CWC for being an outdated organization, hellbent on destroying the life of this poor child.

    Girl was adopted some years back, now girl is 11 years. How many years back she was adopted...!!!??? Is it a rocket science to find out. Now CWC finds adoption was illegal and girl does not wish to go with her biological parents. Which is better for the girl at this point of time....Prajna counselling centre or adopted parents..!!!???? I feel she was happy and must be kept happy by making her to live with adopted parents. By the way where were her biological parents for so many years...!!!????
