High court orders 16 Bengaluru mosques to submit affidavit on loud speakers


Bengaluru, Aug 11 (IANS): The Karnataka High Court has ordered the management of 16 mosques in Bengaluru to submit affidavit in connection with sound pollution on Tuesday.

The divisional bench headed by Chief Justice A.S. Oka and Justice Sanjay Gowda gave directions in this regard. The Public Interest Litigation (PIL) was filed by 32 residents of Icon apartment on Thanisandra Road.

During the hearing, the masjid management submitted that they have taken permissions to use loudspeakers.

The bench stated that the management of masjids has to submit an affidavit before the court on whether they are following the guidelines prescribed by the government to avoid sound pollution.

They also have to mention in the affidavit that, they have obtained a license as per the Pollution Control Board (PCB) guidelines and if a license is not obtained they will not use loudspeakers.

    In Saudi Arabia azan not banned, its true that the second call (acamat salah) sound restricted inside mosque only. Low intensity sound is always sweat to hear from any reliogious institution.

    Eveen saudi govt has placed restrictions recently on use of loud speakers in mosques eatly morning stating that it affects sleep patterns of children and elders. 100 yrs back there were no speakers in mosques

    Noise Pollution Rules 2000 is the law. The max. allowable dB level in: residential area is 55dB , industrial area is 75 dB; during daytime. See order of Supreme Court in Church of God case or Delhi HC in Madhav Roy case. I live between 3 institutions (i’s) called ‘masjid’. The nearest is across the road from my house. I came here with an open mind telling myself that I should not paint everybody with the same brush. I have been proven wrong. All of these i’s have fitted,abt. 40 feet above ground, high decibel horn-type loudspeakers(LS) that have a characteristic of over 110 dB so that they can be heard at least 1- 2kms away by all. Self-righteous people who have no morals or ethics or respect for the law or for civility , go into these structures and scream on the LS, for anywhere between 2 mins to 4 hrs. Rafi saab would have died of shock to hear such screaming. We are hammered: 18 times everyday for between 2 - 20mins from 4.45 am before sunrise to 8.45 pm after sunset; for 1.3 hrs every Friday afternoon when our area turns into a war zone :for who screams loudest in the most rabid, fanatical and breathless manner; for between 2 -4 hrs non-stop on special days that can range from 10-15 days in a year. 99% of the power brokers who control these i’s never build these i’s anywhere near their house. Even a humble pleading to at least turn the LS 180 degree away is ignored. Matters are not so innocuous as they seem: the use of LS’s by these i’s has an insidious purpose of forced proselytization, indoctrination and driving out all those who do not wish to submit to the ideology & expansion of the Caliphate! These same people stuck posters “ Save the Constitution! Say no to CAA/NRC”. Hypocrites who do not respect the rights of others! Then they scream on LS’s: Iman, Iman, Iman; joot aur chori are the greatest sins that the Lah dislikes.

    Maximum mandir and temples, wedding hall in Shatinagar area. Some play bajan early morning and loud music from marriage hall in evening. Its really disturbing to elders, school going childrens. Local admin should frame strict guideline for these noise pollution.

    All laws and guidelines are in place to control noise but the authorities refuse to implement them. In Karnataka ,CP of city police and SP of dist. police are the designated authorities to whom victims, as per the police jurisdiction, of noise pollution should make written complaints to. Address your complaints to the designated authority, not to the police station. Make a complaint under the Noise Pollution Rules 2000. The police claim that nobody is complaining . This is a fact because there are next to no written complaints. Victims of noise pollution may call 112 for immediate relief . You may also use the KSP app. In each of these cases you will receive a complaint number. Tweet to the CP or SP. But, it is essential to make written complaints to the designated authority, if you want long term relief and for the system to improve. Use decibel meter mobile apps to record and provide evidence to police. I recommend Smarternoise app. It has the best features. I do not mind going on record to say that seeking justice is a very difficult thing. If you have influence or muscle power everything works. Rule of law in India depends upon having a good officer in the right place at the right time. Otherwise you will only end up getting frustrated wasting your time, money and health.

    Mobiles and internet changed everything from clock to camera, music etc. Why we need loudspeakers only to wake us up/remind for prayer whether it is from Mosque, Temple or Church....??? Use alarms or online reminders to do so if someone can forget the time of prayers. When people created God for their benefit, The God who created us sent Covid and reminded us that God is within us and it is not required to visit Church/temple/mosque to pray. Our home is the biggest prayer hall and God listens from anywhere.

    Use of loudspeakers by all religions should be fully banned. There is no need for anybody to keep bawling out God's names, bhajans and hymns. Let it be restricted within the premises only. Sound pollution should be avoided by everybody.

    In Hirandahalli main road, (near Avalahalli, KRPuram) there are 2 temples which are using loudspeakers One big hanuman temple newly built and another opposite to this one. Kindly look into this. I am Hindu but i am unable to bear the loudspeakers.

    The first loudspeaker of Alexander Graham Bell was in 1876, the modern loudspeaker of Kellogg and Rice was invented in 1924, all major religions existed much before 1876, so no religion can claim loudspeaker to be compulsory. God Almighty can hear you even if you speak in your mind. A silent word of thanks is enough for a prayer, any thing else can be conveyed in less than a minute, and silently, at any place, at any time.

    I totally agree with you. Ban use of loudspeaker! But why selective??? Use of loudspeaker to be banned irrespective of who uses it! Bajans are played during morning and evening time in almost all the religious places of towns and villages ( this may not be there in big cities)! In market places hawkers too use loudspeaker ( lot ka mall hai bahi etc). During election loudspeakers are used in vehicles and they move all over the town/ villages, but no issue. BAN USE OF LOUDSPEAKER TOTALLY, BUT DON'T BE SELETIVE!

    What is music to some ears can be noise to other .. Each to respect others inconveniences while celebrating but does not happen as one man upmanship order of the day ... Sadly ..... Now law says strictly every one entitled for good sleep as matter of right .. Very clear directions from court to police ... Early Islam obviously technology not available for speakers ... So why suddenly .. also medieval times there was no clocks .. time .. knowledge in general for common man .... Now all have facilities to know time available... Home clocks .. personal watches .. mobile phones ..

    Every kind of Loud speakers must be banned . Being a Hindu I don’t subscribe even to any sounds coming from our temple . Basic speakers for local sound within the permissible day time hours must be accepted . If there is any objection from fellow citizens it must be respected too.

    In my village, every day morning Bhajans are played till 9.00 am everyday in local temple. I am not complaining, they have liberty and NO ONE COMPLAINS and I do not have any objection for that. All noise pollutions happens only with the sound of Azan for 2 minutes X 5 times a day, but not hours of Bhajans for hours.
