Supreme Court Quashes 22 Criminal Cases Against Khushboo

New Delhi, Apr 29 (Agencies): The Supreme Court on Wednesday said Tamil actress Khushboo did not commit any illegality by expressing her views on pre-marital sex and live-in relationship. 

 
A bench headed by Chief Justice K G Balakrishnan ordered for quashing 22 criminal complaints filed in various places in Tamil Nadu against Khushboo for her remarks in a weekly that was published in Tamil in some local magazines in 2005.

Khushboo had challenged a decision of the Madras High Court which had dismissed her plea to quash the cases pending in lower courts. The apex court said her statement on the issue of pre-marital sex and live-in relationship was her personal views and she was at liberty to express her opinion as guaranteed under the fundamental rights enumerated in the Indian Constitution.

Khushboo’s advocate Pinky Anand, had read out a portion of her interview to a magazine whose translated version in a Tamil newspaper created furore. Anand said Khushboo was asked questions about pre-marital sex and AIDS. “None of the educated people will insist that their bride be a virgin,” she had told the magazine.

However, the advocates of the complainants had argued that her comments, allegedly endorsing pre-marital sex, would adversely affect the minds of young people, leading to decay in moral values and country’s ethos.

The complaints claimed that Khushboo’s “insensitive” remarks had “deeply wounded” the Tamil psyche and hence she should be “punished”. The Madras High Court had refused to quash the criminal cases and transferred all cases to the Chief Metropolitan Magistrate’s court in Egmore with the direction for completion them in six months. According to a TV news channel, after hearing the news of the verdict, Khushboo said she stood by her comments on pre-marital sex and live-in relationships.

“When you look around, every celebrity is pinned down for no rhyme or reason and that is quite a harassment,” she told the channel in an interview. “I knew what I had spoken...It is not an easy task for a woman to stand alone and say ‘I believe in what I have spoken’,” she added.

    Dear Readers,I read all the comments over here. Now I have few things to say. When some one gives statement in public they have to think twice. We have so many loop holes in our Law & Constitution. Don’t take advantage of it. But on humanitarian ground, you should not say anything which affects the people of any cast, religion or on any gender.in the society.

    Secondly, we should judge the background of the person who comments. In this case,do you know how much educated she is? She was staying in Andheri,Veeradesai Road 1st cross,Mumbai. She was studying with my cousin’s daughter in same school & class. She used to visit their house in our colony till 6th STD. She acted as a cancer patient in Mr.Sunil Dutt’s film “Dard Ka Ristha” & it was a super hit. Since after she got few more chances in films as a child artist. She could not continue her education. She discontinued her studies from 7th or 8th Std. But she could not succeed as a heroine. When she got a chance in Tamil movie shifted to Tamil Nadu & settled there. No doubt she was very popular & some silly people constructed a Temple in her name. Now she must be having degree certificates with her! The great talented actress Ms.Rekha once openly told in a live TV talk show, “Not a single female in film industry can prove them self as a virgin”

    Now you can judge a person’s mentality & respect their statements. Education, profession & the living style influences their mentality. What ever they want to do let them do privately

    I am with Khushboo. But frankly speaking some underdeveloped families will have a pinch. They will talk about culture,religion,custom etc.,& refused to face the facts of the modern world. They are one of such people who produce 8 children and say 'God has given'.

    I think the court has overstepped in its statement. The Indian constitution guarantees right of expression to its citizens irrespective of creed, caste, faith and gender. If Khusboo can be acquitted for her remarks on premarital sex and live in relationships, as her personal opinion, then every bonafide citizen like Khushoo should be guaranteed of such rights. Freedom of expression needs to be redefined. In the name of freedom of sppech/expression, one dare not and cannot inflict damages to the soical fabrics and values of society and life. One can't incite communual tension, one cant call upon the killing and cutting off the limbs of another person, one cant call upon the massacre of killing others who dont believe in their philosophy. Of all the violations and misuse of right of speech and expression, leaders like Advani, Togadia, Modi, Vinay Kataria, Muthalik, Bal and Raj Thackerey calling for killings of others based on their faith, regions etc. No one has the right to talk what he feels. There must be some censure and restraints in public life and public address.

    Madam, I thought you follow particular philosophy. But now you have applied double standard and deviated from your own stand. When I wrote about Ms Ramya shetty having eloped with Mohamed, lost her virginity, you made a big issue as if the sky has come down on earth. Now you too talk about viriginity and now you dont feel ashamed to talk about it as you feel being a woman you feel it is just your right to speak about virginity and man has no say on the issue.     This is a common practice by some who target rich & famous for cheap publicity which should not be taken seriously. The court should look into the pros & cons of the nature of such cases before accepting them or this will waste the precious time & money of the judges and the judicial system. This has no substance except a piece of juicy matter for yellow journalism.

    You have misrepresented her comment. As per the magazine it was...a educated person will not marry a vergin. If anyone will not have pre marital sex there is some thing wrong with them. This even argued in the national news channel and she said, she has not given any interview to magazine???? where as in court she has agreed of giving interview to magazine.

    Do we have to go allover again about which religion teaches what ? Kushboo did not say anything about sinning, she said “None of the educated people will insist that their bride be a virgin,”

    As per her, its upto men and WOMEN to check whether or not their partner is virgin and then get married. Would educated people like being subjecting to pre-marriage virginity test or just get married to the man/woman they like as is ?

    It is not the comment of this actress which spoiled the minds of young people, but the amount of publicity given to her comment really harmed. We read and hear opinions of people based on what they think which again depends on their background and responsibility they own for the society. Let it go on.     Hearty congratulations Khushboo on winning the subject case, and good on you to stand by your earlier views and comments. Pre-marital sex and live-in relationship is fine, for the case of educated lot at least, as you rightly say, and it`s an individual matter as long as they are consenting adults who can make their own decision, and these issues should not be governed and influenced by the Society`s ethos and moral values, which are, sorry to say, somewhat, primitive in Indian scene. Of course, this is my personal view and should not, in any way, be taken as a modus operandi.
