Ex-CJIs warn against granting sweeping powers to EC in One Nation, One Election plan

New Delhi, Jul 11: Former Chief Justices of India DY Chandrachud and JS Khehar have raised serious concerns over the proposed One Nation, One Election system, cautioning a Joint Parliamentary Committee (JPC) against granting the Election Commission of India unbridled powers under the draft constitutional amendment.

Appearing before the JPC examining the Constitution (One Hundred and Twenty-Ninth Amendment) Bill, 2024, and the Union Territories Laws (Amendment) Bill, 2024, both jurists made a strong pitch for a ‘system of checks and balances’ to prevent misuse of authority.

Sources said the former top judges emphasized that while simultaneous elections may serve administrative convenience, the sweeping powers proposed for the EC in the current draft risk undermining democratic safeguards. They also advocated for an independent oversight mechanism to monitor the poll body's conduct.

Importantly, they reiterated that a full five-year term for elected governments must be protected for ensuring good governance. “This term should not be curtailed under any circumstances,” a source quoted the judges as saying.

DY Chandrachud had earlier remarked that frequent elections and short tenures can stall meaningful policy implementation, as the Model Code of Conduct kicks in well before the next polls.

Reacting to the suggestions, JPC chairman and BJP MP PP Chaudhary said, “If we feel the bill needs amendment, we will amend it. Our report will be sent to Parliament only after ensuring national interest.” He reaffirmed the government’s commitment to the One Nation, One Election vision, calling it essential for “nation-building” and preserving constitutional integrity.

So far, four former CJIs, including UU Lalit and Ranjan Gogoi, have deposed before the committee. While opposition leaders have criticized the bill, citing threats to federalism and constitutional structure, most jurists appearing before the panel have rejected those claims.

The JPC's recommendations are expected to play a pivotal role in shaping the future of India’s electoral system.
