All eyes on Governor as Karnataka throws fractured mandate


Bengaluru, May 15 (IANS): All eyes were on Karnataka Governor Vajubhai Vala on Tuesday after hotly-contested elections threw up a hung Assembly, forcing the BJP and a hurriedly stitched alliance of the Congress and the JD-S to stake claim to form a government.

The BJP, which appeared confident of returning to power in its only southern bastion, emerged as the single largest party but failed to cross the half-way mark in the 224-member Assembly where two constituencies didn't vote on Saturday.

The Election Commission data showed that the BJP could end up with 104 seats -- eight short of simple majority.

The Congress appeared to have learnt from its mistakes in Manipur and Goa where it, despite emerging as the single largest party in both states, reacted late and gave the BJP enough time to cobble together an alliance with smaller parties to form governments there.

This time, the Congress, set to win 78 seats, sprung a surprise and quickly announced its support to the Janata Dal-Secular which finished third with 37 seats in a bid to keep the BJP away from forming a government.

Congress General Secretary Ghulam Nabi Azad told the media in the company of outgoing Chief Minister Siddaramaiah that the JD-S and the Congress "will meet the Governor and stake claim (to form a government)".

Led by former Prime Minister H.D. Deve Gowda, the JD-S quickly accepted the offer and wrote to the Governor staking claim to power.

Both JD-S leader and former Chief Minister H.D. Kumaraswamy and Siddaramaiah of Congress then met the Governor and staked the claim to form a government.

"I have accepted the support extended by the Congress to form the government," Kumaraswamy said.

That happened after BJP leader and its Chief Ministerial candidate B.S. Yeddyurappa met and urged the Governor to let him prove his majority support in the Karnataka Assembly. He was accompanied by Union Minister Ananth Kumar.

The ball now lies in the Governor's court. According to usual practice, the Governor calls the leader of the single largest party or pre-poll alliance to form the government.

In the case of a hung Assembly, the leader is asked to prove the majority on the floor of the House within a stipulated time.

In Karnataka, the Congress and JD-S did not have a pre-poll alliance. However, it is for the Governor to take a call on who to invite first.

The dramatic turn of events that saw BJP's jubilations swinging up and down throughout the day spoiled its hopes to form its own government in Karntaka -- its gateway to the south.

According to party sources, three senior ministers -- Dhamendra Pradhan, Prakash Javadekar and J.P. Nadda -- have been rushed to Karnataka to strategise with the local leadership.

Mocking at the "desperation of a defeated Congress" to support the JD-S to form a coalition government to keep the BJP out of power, BJP spokesman Shantaram said his party was open to an alliance with the JD-S or seek its support to form the new government.

"We are open to JD-S support, if need be, after all the results are declared. Our approach to JD-S will depend on the number of legislators we need to prove majority in the house or win the confidence motion," he said.

BJP activists and leaders earlier celebrated noisily in both Bengaluru and New Delhi, waving party flags and shouting slogans hailing Prime Minister Narendra Modi, their main vote-getter, and Amit Shah.

Expectations of a BJP victory in Karnataka lifted the key Indian equity indices during the mid-morning trade session on Tuesday. But the markets later went into the red.

    Governor should strictly follow the guidelines laid down by the SC in case of Bihar and allow JDS-Congress combine to form the government. SC had clearly said any party or coalition, pre or post alliance that has required numbers when they approach Governor should be invited to form government. Same principle has been followed by BJP in Meghalaya, Tripura and Goa where Congress was largest party and BJP second, but BJP and Coalition were invited by Governors to form government because they had numbers when they approached Governor. BJP or bakhts have no reason to complain because they have agreed to the above three coalition and also that of Vajpayee led government in 1997!!!!. Inviting BJP to form government will see dirty horse trading with money and muscle power!!

    What comes next?
    Governor takes time to consult: The situation is not simple and might require legal consultations, and so the governor might take some time to decide on whom to invite to form government. Time, of course, is very valuable in circumstances like this, and it will favour the BJP, which will attempt to get MLAs from Congress and/or JD(S) to resign or abstain.
    Governor invites the Congress-JD(S) combine to form government: This scenario would seem the most appropriate and in keeping with the precedent established by governors in the last few years, when in Goa and Manipur, the largest coalition (including the BJP in both of those cases) was invited to form the government, rather than the single largest party (which happened to be Congress in those two states). But the governor, a political appointee and a person who has deep BJP roots, is expected to try whatever is possible to avoid having to do this.
    Governor invites the BJP to form government: The BJP is the single-largest party, and so there might be cause for the governor to invite it to prove its majority on the floor. This would be breaking with the precedent of the last few years, when the BJP actively argued in court that the governor can call a coalition if it has the numbers and will be stable. The BJP, when it staked claim on Tuesday, asked for a week to get its MLAs together before a floor test. It is likely that, if the governor goes down this route, he will also give the BJP that much time, during which it can attempt to persuade 15 MLAs from other parties to abstain or resign (BJP’s tally of 104 will allow it to prove majority only in a house of 207, and the effective strength of the house right now is 222).

    Hung assembly? Hanging is too easy a method for these people. RG successfully loses so many elections but he is never held accountable for these debacles.     Congress - 38 %votes, BJP 36% votes, JDS 18%votes...........BJP has been rejected by 54%. So I think the mandate is against BJP very clear. So morally and politically Congress + JDS has the right to form govt. NOT BJP

    Poaching of MLAs by the BJP from JDS or Congress by paying huge bribes is totally unethical. Also it’s unethical on the part of those MLAs to desert the party that has elected them. So how can you justify BJP forming government unless JDS openly supports them as they supported Congress???

    please remember - all rules are flexible when it comes to BJP.... Goa and Manipur are two examples we can quickly look at. What happened? NOW it is Karnataka,,, they want to rule and the Governor will allow it. May be 30 days later the floor test so that BJP CAN buy all the required numbers !

    The JDS leader who will be the CM in association with the Congress already has written to the Governor that he has the majority to rule Karnataka. Then how the Governor has to give one week for the BJP to prove the majority.? The Governor is expecting BJP to do some big time trading with the MLAs of both Congress and the JDS MLAs. We have watched that trading in the North Indian States and in Goa.

    One must remember that Governor Vajubhai Vala vacated his seat for Narendra Modi in 2014 Lok Sabha elections. When the Governor of Goa didn’t invite the Congress, despite it being the single largest party, there is little chance the that the Karnataka Governor (a BJP appointee) will give Congress the first shot at government formation.

    Sir,Then finance minister, Arun Jaitley, who’s also a noted Supreme Court lawyer, had made a passionate defence explaining why the governor was right to invite the combination with the majority support than the single largest party.

    This is what he had written;

    The Congress Party complains a bit too much. It accused the Bharatiya Janata Party (BJP) of ‘stealing’ the mandate in Goa. It unsuccessfully petitioned before the Supreme Court. It attempted to raise issues in the Lok Sabha. What are the facts?

    The assembly elections in Goa produced an inconclusive verdict. There was a hung assembly. Obviously in a hung assembly post-poll alliances will be formed. The BJP managed to form an alliance and presented to the Governor 21 out of 40 MLAs.

    They appeared before the Governor in person and submitted a letter of support. The Congress did not even submit a claim to the Governor. It had only the support of 17 MLAs. The Congress Party protested at the Governor’s decision to invite Mr Manohar Parrikar to form the Government with support of 21 out of 40 MLAs and described it as ‘a murder of democracy’.

    In the face of claim of these 21 MLAs led by Mr Manohar Parrikar, the Governor could not have invited the minority of 17 MLAs to form the Government. There are several precedents which support this decision of the Governor.

    • In 2005, BJP won 30 out of 81 seats in Jharkhand. The JMM leader Shri Shibu Soren with a support of 17 MLAs of his party plus others was invited to form the government .
    • In J&K in 2002, the National Conference won 28 MLAs but the Governor invited the PDP & Congress combination of 15 + 21 MLAs to form the government.
    • In 2013, the BJP won 31 seats in Delhi, but the AAP with 28 MLAs with support of Congress was invited to form the government.

    Your logic is applicable if the CM Candidate of the union Government of JDS-Congress didn't send a letter already to the Governor that they have the majority to form the Government. If such a letter was not forwarded to the Governor, then he has the right to talk with the major party BJP at first.

    There are latest development emerging from Amit Shah office in daily. As per the plan BJP will pursue DK Shivakumar to cross party with is winning supporters using the threat of Enforcement Directorate in pending case.
    The plan goes well it will reduce the majority of the combined total of JD(S)-Congress below the required strength of 113 magic figure. In the scenario Governor will ask JD(S) to go for floor test to prove his majority with Congress.

    In likely scenario if BJP manage to secure DK Shivakumar and other lose party members from the parties to jump the ship and join them with some plum post.

    The delaying tactics of Governor is nothing but buying time for back door 'hoarse trading' to facilitate and prove his loyalty RSS political wing BJP.
