Supreme Court rejects plea against Bopaiah's appointment as pro-term speaker

Bengaluru/New Delhi, May 19: The Supreme Court on Saturday May 19 turned down the plea against appointment of K G Bopaiah as the pro-tem speaker for the Karnataka assembly floor test filed by the Congress and the JD(S).

Dismissing the plea, the three-member of the Supreme Court said that Bopaiah would continue as the pro-tem speaker.

The Supreme Court ordered live streaming of the floor test at 4 pm.

The court also noted that several regional channels will be provided with live feeds for the telecast.

As there would be live videography and broadcast of the floor test, the SC said it would be the best way to ensure transparency of proceedings.

"Law cannot direct the governor to appoint a particular person as pro-tem speaker. Unless convention becomes legal norm, it cannot be enforced by the court," the SC said.

The bench also said that examination of the governor's decision on appoinment of the pro-tem speaker would go against the SC's decision on the floor test given a day earlier.

    KG Bopaiah, who has been appointed as the pro tem speaker ahead of the crucial vote of confidence in the Karnataka Assembly, was rapped by the Supreme Court for being partisan during the vote of confidence in 2010.

    “Drastic and partisan step taken in hot haste and great hurry with extraneous considerations,” were the words use by Supreme Court while striking down Bopaiah’s decision in 2010, disqualifying 16 MLAs to ensure that the then chief minister BS Yeddyurappa won the trust vote.

    On October 2010, a vote of confidence was called after several BJP MLAs had objected to the government under the leadership of Yeddyurappa. In a controversial move, the then Speaker Bopaiah had disqualified 11 BJP MLAs and 5 Independents.

    The matter went to the court and in its judgment, the Supreme Court on 13 May 2011 had said: "The procedure adopted by the Speaker seems to indicate that he was trying to meet the time schedule set by the Governor for the trial of strength in the Assembly and to ensure that the appellants and the other independent MLAs stood disqualified prior to the date on which the floor was to be held. It would appear that such a course of action was adopted by the Speaker on 10 October 2010 since the vote of confidence was slated for 12 October," read the Supreme Court’s order.

    In the current Assembly, 8th time MLA and Congress leader RV Deshpande is the senior-most member. Even in the BJP, Bopaiah is not the senior-most, the BJP’s Umesh Katti has been elected to the House seven times.

    The three-member bench of the Supreme Court must have forgotten the history of Speaker Bopia's which Supreme Court called biased in 2010 Floor Test. Now once again RSS main appointed in action to serve the BJP.

    Read the SC comments properly....SC said it cannot direct the Governor for this issue... there have been previous many instances where the senior most MLA was not the Pro Tem speaker.... Congress does not have any point to argue on this,,,, they have to agree...

    K.G. Bopaiah was rebuked for disqualifying 11 congress MLA's by the supreme court previously.

    Whatever be Bopaiah was accepted by the supreme court and I respect S.C.'s decision.

    However Kilo Gram Bopaiah was faltered / tainted before the S,C. previously.
